HomeMy WebLinkAboutRes No 510PLANNING COMMISSION RESOLUTION NO. 510 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA ANNOUNCING FINDINGS AND APPROVING A VARIANCE FROM THE REQUIREMENTS OF THE PALM DESERT MUNICIPAL CODE (SIGN ORDINANCE) REGARDING THE USE OF FREE-STANDING IDENTIFICATION SIGNS IN COMMERCIAL AND INDUSTRIAL ZONES. CASE NO. VAR 04-79 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on July 18, 1979 hold a duly noticed Public Hearing to consider the application of MYRA GOLDWATER REALTOR and CALIFORNIA CANA- DIAN BANK, requesting a variance from Section 25.68.310 of the Palm Desert Municipal Code to allow errection of a joint use free-standing sign located at the intersection of Parkview Drive and Highway 111, more parti- cularly described as: APN 621-303-001 WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, the Planning Commission did find the following facts and reasons to exist to justify the approval of said variance: 1. The strict or literal interpretation and enforcement of the adopted Sign Ordinance will result in practical difficulty or unnecessary physical hardship inconsistent with the objectives of the Ordinance. 2. There are recognizable exceptional or extraordinary circumstances or conditions involved that do not generally apply to other commercial buildings with similar orienta- tions. 3. The 'exception' is temporary in nature, and will thereafter conform to the Sign Ordinance. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That Case. No. VAR 05-79 is hereby approved, subject to the conditions contained in the attached. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 18th day of July,1979, by the following vote, to wit: AYES: Berkey, Fleshman, Kryder, Snyder NOES: None ABSENT: Miller ABSTAIN: None WALTER SNYDER, ATTEST: PAUL A. WILLIAMS, Secretary /lr PLANNING COMMISSION RESOLUTION NO. 510 Page 2 CONDITIONS OF APPROVAL Case No. VAR 05-79 1. Design of Sign shall conform with Exhibit A (Case No. VAR 05-79) on file with the Department of Environmental Services, as modified by the following conditions. 2. Use of the approval granted herein shall be subject to the restrictions and limitations of all Municipal Ordinances and State and Federal Statutes now in force, or which hereafter may be in force, except as otherwise specifically provided by this approval. 3. Prior to the issuance of a building permit to errect the sign contemplated by this approval, the applicant(s) shall first complete all procedural requirements of the City which includes, but not limited to, Design Review process, and related building permit procedures. 4. This approval is granted for a maximum period of 18 months, or the termination of occupancy of either tenant, whichever comes first. There- after, all signing shall conform to the Municipal Code (Sign Ordinance) Section 25.68.et.sec. 5. Except for the provision of a maximum of a three square foot entrance sign for each business, no other signs shall be permitted on the building.
