HomeMy WebLinkAboutRes No 514PLANNING COMMISSION RESOLUTION NO. 514 L A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND APPROVING A TENTATIVE PARCEL MAP TO DIVIDE APPROXIMATELY 15.52 ACRES INTO TWO PARCELS. CASE NO. PM 14647 WHEREAS, the Planning Commission of the City of Palm Desert, California, did hold a duly noticed Public Hearing on the 31st day of July, 1979, to consider the request by GERALD J. CHAZEN for approval of a Tentative Parcel Map to divide approximately 15.52 acres into two parcels within the PC(3), S.P. (Planned Com- mercial, Regional, Scenic Preservation Overlay) zone, generally located Southeast of the intersection of Highway 111 and El Paseo, approximately 420 feet west of Plaza Way, more particularly described as: APN 629-720-015 APN 629-720-016 WHEREAS, at said Public Hearing, upon hearing and considering the testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to justify approval of the Parcel Map: 1 The subject Tentative Parcel Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended. 2 The subject Tentative Parcel Map does comply with the adopted General Plan and the Palm Desert Zoning Ordinance. 3. The site is physically suitable for the type of development proposed. 4. The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or serious health problems. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That it does hereby approve the above described Tentative Parcel Map No. 14647,subject to fulfillment of the attached conditions. PASSED, APPROVED, and ADOPTED at an adjourned meeting of the Palm Desert Planning Commission, held on this 2nd day of August, 1979, by the following vote, to wit: AYES: Berkay, Fleshman, Kryder, Snyder NOES: None ABSENT: Miller ABSTAIN: None WALTER SNYDER, Chairman ATTEST: Alermelit-PAUL A. WILLIAMS, Secretary /ls PLANNING COMMISSION RESO. NO. 514 Page Two STANDARD CONDITIONS OF APPROVAL CASE NO. TENTATIVE PARCEL MAP 14647 err 1. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and State and Federal Statutes now in force, or which hereafter may be in force. 2. Full public improvements including traffic safety lighting as required by Ordinance and the City Engineer shall be installed in accordance with City standards. 3. Improvement plans for water and sewer system shall meet the requirements of the respective service districts. 4. Area shall be annexed to appropriate Improvement Districts having jurisdiction over the subject area. 5. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. 6. All on -site utilities, including cable TV, shall be placed underground and shall be completely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services. 7. Complete plans and specifications shall be submitted as required by Ordinance to the City Engineer for checking and approval before construction of any improvements is commenced. The subdivider shall submit "as -built" plans prior to acceptance of the subdivision improvements by the City. 8. In order to maintain reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings. An adequate number of fire hydrants with required fire flows shall be installed as recommended by the Fire Marshal. 9. Prior to recordation of the Final Map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 10. All requirements of the City Fire Marshal in letter dated July 13, 1979 shall be met as a part of the development of this tract. 11. The water system shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system of Parcel Map No. 14647 is in accordance with the require- ments prescribed by the City Fire Marshal." 12. Drainage shall be subject to approval of the City Engineer. Applicant shall provide engineered data as requested. 13. All requirements of the Planning Commission action on the Development Plan 05-79 shall be met as a part of the development of this tract. 14. The total number of parcels shall be limited to two. 15. The applicant shall have twelve (12) months from the date of the approval or conditional approval of the tentative map for filing of the final map unless an extention of time of up to eighteen (18) months is granted by a Resolution of the City Council. 16. Drainage and Signalization Fund contributions as required by City Ordinance shall be made prior to recordation of the Final Map. • SPECIAL CONDITIONS OF APPROVAL 1. The installation of curb, gutter, tie-in paving, and sidewalk shall be required around the entire frontage of proposed parcel no. 2; in addition to street improvements required for Development Plan 05-79.
