A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM
DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING A
PARKING VARIANCE IN THE MARKET BASKET CENTER, ON THE NORTH
SIDE OF EL PASEO, WEST OF LARKSPUR LANE.
CASE NO. VAR 06-79
WHEREAS, pursuant to the provisions of the Palm Desert Zoning
Ordinance, the Planning Commission of the City of Palm Desert, Calif-
ornia, did on July 31, 1979, hold a duly noticed Public Hearing to
consider an application from EGS METRO requesting approval of a
Variance from Section 25.58.310, of the City of Palm Desert Municipal
Code ("commercial and industrial off-street parking schedule"), to
allow construction of a 5,120 sq.ft. commercial building in the rear of
the Market Basket Center, within the C-1, S.P. (General Commercial,
Scenic Preservation Overlay) zone located on the north side of El Paseo,
west of Larkspur Lane, more particularly described as:

WHEREAS, said application has complied with the requirements of the
"City of Palm Desert Environmental Quality Procedure Resolution No. 78-32",
in that the subject project has not been found to present an adverse
impact on the environment and a Negative Declaration has been prepared.
WHEREAS, at said Public Hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring
to be heard, said Commission did find the following facts and reasons
to exist to justify the approval of a Variance to reduce the number of
parking spaces from 285 spaces required by the Municipal Code to 241:
1. The existing parking area in the rear of the center is under-
utilized.
2. The improvements associated with the proposal will enhance the
public view of the center.
3. The mandatory findings the Planning Commission must make when
granting a Variance as specified in Section 25.78.070 of the Palm
Desert Municipal Code are applicable to the subject case.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute
the findings of the Commission in this case;
2. That approval of Parking Variance VAR 06-79 is hereby granted
for reasons, subject to the attached conditions.
PASSED, APPROVED, and ADOPTED at an adjourned meeting of the Palm Desert
Planning Commission, held on this 2nd day of August, 1979, by the following vote,
to wit:

CONDITIONS OF APPROVAL
CASE NO. VAR 06-79
1. Development of the property shall conform substantially with that
as shown on plot plan marked Exhibit 'A' on file with the Dept. of
Environmental Services, Case 96C and VAR 06-79, unless otherwise
amended by the following conditions:
2. The development and use of the property described herein shall be
subject to the restrictions and limitations set forth herein which
are in addition to all the requirements, limitations, and restric-
tions of all municipal ordinances and Sate and Federal statutes
now in force, or which hereafter may be in force.
3. Prior to issuance of a building permit,revised plans shall be sub-
mitted for the Design Review process which address the following
subjects:
a. A Plan providing for increased landscaping in the rear of
the center oriented to El Paseo.
b. Architectural screening of all roof mounted mechanical and
air conditioning equipment now visible from El Paseo.
c. A plan providing for screened and enclosed trash storage areas,
conveniently located to each of the center tenants.
d. A revised parking layout which deletes the parallel parking
along the west property line which encroaches into the re-
quired 24' width for two directional driveway isles.
