HomeMy WebLinkAboutRes No 542PLANNING COMMISSION RESOLUTION NO. 542 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND APPROVING A TENTATIVE PARCEL MAP TO CONSOLIDATE TWO (2) LOTS INTO ONE PARCEL LOCATED AT THE NORTHWEST CORNER OF SAN GORGONIO AND SAN PABLO AVENUES. CASE NO. PM 15550 WHEREAS, the Planning Commission of the City of Palm Desert, California, did hold a duly noticed Public Hearing on October 30, 1979, to consider a request by Jake Eberle for approval of a Parcel Map to consolidate two (2) lots into one parcel on approximately .52 acres within the R-2, S.P. (Single Family Residential, Scenic Preservation Overlay) zone generally located at the northwest corner of San Gorgonio and San Pablo Avenues, more particularly described as: APN 627-085-018 APN 627-085-019 WHEREAS, at said Public Hearing, upon hearing and considering the testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to justify approval of the Parcel Map: 1. The subject Tentative Parcel Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended. 2. The subject Tentative Parcel Map does comply with the adopted General Plan and the Palm Desert Zoning Ordinance. 3. The site is physically suitable for the type of development proposed. 4. The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or serious health problems. NOW, THEREFORE, BE IT RESOLVED by the Planning Coiimiission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That it does hereby approve the above described Tentative Parcel Map No. 15550 subject to fulfillment of the attached conditions. PASSED, APPROVED, AND ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 30th day of October, 1979, by the following vote, to wit: AYES: Berkey, Fleshman, Kryder, Miller, Snyder NOES: None ABSENT: None ABSTAIN: None ALTER SNYDER, a411.04(--) ATTEST: PAUL A. WILLIAMS, Secretary /dj PLANNING COMMISSION RESOLUTION NO. 542 Page 2. STANDARD CONDITIONS OF APPROVAL CASE NO. TENTATIVE PARCEL MAP 15550 1. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and State and Federal statutes now in force, or which here- after may be in force. 2. Full public improvements including traffic safety lighting as required by Ordinance and the City Engineer shall be installed in accordance with City standards. 3. Access rights on San Gorgonio Way shall be offered to the City as a dedication on the Final Map. 4. Improvement plans for water and sewer system shall meet the requirements of the respective service districts. 5. Area shall be annexed to appropriate Improvement Districts having juris- diction over the subject area. 6. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. 7. All on -site utilities, including cable TV, shall be placed underground and shall be completely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services. 8. Complete plans and specifications shall be submitted as required by Ordinance to the City Engineer for checking and approval before construc- tion of any improvements is commenced. The subdivider shall submit "as -built" plans prior to acceptance of the parcel improvements by the City. 9. In order to maintain reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings. An adequate number of fire hydrants with required fire flows shall be installed as recommended by the Fire Marshal. 10. Prior to recordation of the Final Map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 11. All requirements of the City Fire Marshal shall be met as a part of the development of this tract. 12. The water system shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system of Parcel Map No. 15550 is in accordance with the requirements prescribed by the City Fire Marshal." 13. Drainage shall be subject to approval of the City Engineer. Applicant shall provide engineered data as requested. 14. All requirements of the Design Review Board and Planning Commission action on Case No. 176 MF shall be met as a part of the development of this Parcel Map. 15. The total number of parcels shall be limited to one. 16. The applicant shall have twelve (12) months from the date of the approval or conditional approval of the tentative map for filing of the final map unless an extension of time of up to eighteen (18) months is granted by a Resolution of the City Council. 17. Drainage and Signalization Fund contributions as required by City Ordinance shall be made prior to recordation of the Final Map. PLANNING COMMISSION RESOLUTION NO. 542 Page 3. SPECIAL CONDITIONS OF APPROVAL CASE NO. TENTATIVE PARCEL MAP 15550 1. The map shall be revised to reflect a 50 ft. wide half street section for San Pablo Avenue (100 ft. total future right-of-way). 2. All street frontages shall be developed with full improvements (i.e., curb, gutters, sidewalks, and tie-in paving), and dedication provided as required by the Director of Public Works.
