A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, ANNOUNCING FINDING AND GRANTING A
CONDITIONAL USE PERMIT AMENDMENT TO ALLOW AN ADDITION-
AL TWO RESTAURANTS FOR PROPERTY GENERALLY LOCATED ON
THE NORTHEAST CORNER OF HWY 74 AND EL PASEO.
CASE NO. CUP 09-78 (Amendment)
WHEREAS, the Planning Commission of the City of Palm Desert,
California, did on the 2nd day of October, 1979 hold a duly noticed
Public Hearing and continued Public Hearing on October 30, 1979, to
consider the request by Hughes Investments for approval of an amend-
ment of an approved Conditional Use Permit to allow an additional two
restaurants on approximately 5.4 acres (total Hughes Investment site)
within the C-1, S.P. (General Commercial, Scenic Preservation Overlay)
zone, generally located at the northeast corner of Hwy 74 and El Paseo,
more particularly described as:
APN 627-192-036 (previously 627-192-27)
WHEREAS, said application has complied with the requirements
of the "City of Palm Desert Environmental Quality Procedure Resolution
No. 78-32", in that the Director of Environmental Services has deter-
mined that the project has been previously assessed in connection with
the original use permit review, and that further documentation is not
deemed necessary; and
WHEREAS, at said Public Hearing, upon hearing and considering
all testimony and arguments, if any, of all interested persons desiring
to be heard, said Commission did find the following facts and reasons to
exist to justify the approval of said Conditional Use Permit amendment:
1. The proposed location of the conditional use amendment
access and the conditions under which it could be operated
and maintained will not be detrimental to the public health,
safety, or general welfare, or be materially injurious to
the properties or improvements in the vicinity.
2. The proposed conditional use does comply with the goals,
objectives, and policies of the City's adopted General
Plan.
3. The proposed conditional use does comply with the goals,
objectives, and policies of the City's adopted Redevelop-
ment Plan.
4. That the proposed Conditional Use Permit function as a
single commercial development which is found to be equiv-
alent to other regional or district centers of the same
size and nature in the vicinity with regard to parking
demand.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of
the City of Palm Desert, California, as follows:
1. That the above recitations are true and correct and consti-
tute the finding of the Commission in this case;
2. That the Conditional Use Permit (CUP 09-78, Amendment) is
hereby approved subject to the addition of 21 parking spaces
and the further stipulation that no additional restaurant
footage be permitted.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm
Desert Planning Commission, held on this 30th day of October, 1979, by
the following vote, to wit:
AYES: Berkey, Fleshman, Kryder, Snyder
NOES: Miller
