HomeMy WebLinkAboutRes No 547PLANNING COMMISSION RESOLUTION NO. 547 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDING AND DENYING A CONDITIONAL USE PERMIT AMENDMENT TO ALLOW AN ADDITION- AL DRIVEWAY ACCESS FOR PROPERTY GENERALLY LOCATED ON THE NORTHEAST CORNER OF HIGHWAY 74 AND EL PASEO. CASE NO. CUP 09-78 (Amendment) WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 2nd day of October, 1979, hold a duly noticed Public Hearing and continued Public Hearing on October 30, 1979, to consider the request by Bank of Indio (Hughes Investments) for approval of an amendment of an approved Conditional Use Permit to allow an additional driveway entrance on El Paseo to facilitate access to a proposed bank building on approximately 5.4 acres (total Hughes Invest- ment site) within the C-1, S.P. (General Commercial, Scenic Preserva- tion Overlay) zone, generally located at the northeast corner of Highway 74 and El Paseo, more particularly described as: APN 627-192-036 (previously 627-192-27) WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32", in that the Director of Environmental Services has determined that the project has been previously assessed in connection with the original use permit review, and that further documentation is not deemed necessary; and WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Commission did find the following facts and reasons to exist to justify the denial of said Conditional Use Permit amendment: 1. The proposed location of the conditional use amendment access and the conditions under which it could be operated and maintained will be detrimental to the public health, safety, or general welfare, or be materially injurious to the properties or improvements in the vicinity. 2. The proposed conditional use does not comply with the goals, objectives, and policies of the City's adopted General Plan. 3. The proposed conditional use does not comply with the goals, objectives, and policies of the City's adopted Redevelopment Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and consti- tute the findings of the Commission in this case; 2. That the Conditional Use Permit (CUP 09-78, Amendment) is hereby denied. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 30th day of October, 1979, by the following vote, to wit: AYES: Berkey, Fleshman, Miller, Snyder NOES: Kryder ABSENT: None ABSTAIN: None WALTER H.
