HomeMy WebLinkAboutRes No 550PLANNING COMMISSION RESOLUTION NO. 550 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A REQUEST FOR APPROVAL OF AN AMENDMENT TO PHASE I OF AN APPROVED RESIDENTIAL DEVELOPMENT PLAN LOCATED AT THE NORTHEAST CORNER OF COUNTRY CLUB DRIVE AND COOK STREET. CASE NO. DP 09-79 (Amendment) WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 14th day of November, 1979, hold a duly noticed Public Hearing to consider a request by PACIFIC COAST BUILDERS for approval of a request to allow amendment of Phase I design, and number and type of dwelling units to be constructed; and, to clarify the Club- house square footage and parking ratio on approximately 404 acres with- in the PR-3, S.P. (Planned Residential, max. 3 d.u./ac., Scenic Preservation Overlay) (Upon Annexation) zone located at the northeast corner of Country Club Drive and Cook Street, more particularly described as: APN 619-021-001 APN 619-021-002 APN 619-021-003 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32", in that the Director of Environmental Services has determined that the project has previously been assessed in connection with Case Nos. DP 09-79 and TT 15000, and no further documentation is deemed necessary. WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts to justify their actions, as described below: a. The proposed project amendment generally conforms to the intent and purpose of the PR Zone District. b. The proposed project amendment is adequately suited for the specific site and is compatible with existing and proposed development in the area. c. The proposed project amendment will not be detrimental to the health, safety and general welfare of the community. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and consti- tute the findings of the Commission in this case. 2. That the Planning Commission does hereby approve conceptual Development Plan No. DP 09-79 (Amendment) (Exhibit A) sub- ject to those conditions attached hereto. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 14th day of November , 1979, by the following Note, to wit: AYES: BERKEY, KRYDER, MILLER, SNYDER NOES: NONE ABSENT: FLESHMAN ABSTAIN: NONE WALTER SNYDER, Chair PAUL A. WILLIAMS, Secretary PLANNING COMMISSION RESOLUTION NO. 550 Page 2. STANDARD CONDITIONS OF APPROVAL Case No. DP 09-79 (Amendment) 1. That this amendment approval is granted subject to the fulfillment of the conditions contained in Planning Commission Resolution No. 525, as they relate to this portion of the project. 2. Wind/blowsand protection, as approved through the Design Review process, shall be installed in the initial stage of construction. 3. The number of swimming pool areas, as shown on the conceptual site plan for Phase I, shall either be increased by 1 to 2, or the pool sizes enlarged and submitted for approval through the Design Review process. 4. A revised Tentative Map shall be filed showing all changes as a result of this approval.
