HomeMy WebLinkAboutRes No 559PLANNING COMMISSION RESOLUTION NO. 559 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND GRANTING AN AMENDMENT OF A CONDITION TO AN APPROVED CONDITIONAL USE PERMIT WHICH ALLOWS CONSTRUCTION OF A RACQUETBALL AND HEALTH CLUB ON APPROXIMATELY 1.4 ACRES WITHIN THE R-3(4) ZONE. CASE NO. CUP 03-79 (AMENDMENT) WHEREAS, the Planning Commission of the City of Palm Desert, California, did hold a duly noticed Public Hearing on December 19, 1979, to consider a request by JACK WISE to allow amendment to an approved Conditional Use Permit condition which requires undergrounding of existing utilities adjacent to the site from the nearest existing pole not on the property being developed, to allow construction of a racquetball and health club on approxi- mately 1.4 acres within the R-3(4) (Multi -family Residential, 4,000 sq. ft. per unit) zone located on Lots 6 and 7, Palma Village Unit #3, more particu- larly described as: APN 627-153-011 APN 627-153-012 WHEREAS, said application has compled with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 73-32", in that the Director of Environmental Services has determined that the project would not have a significant impact on the environment, and a Negative Declaration has been prepared in connection with the original application; and, WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Commission did find the following facts and reasons to exist to justify the granting of said Conditional Use Permit Condition Amendment: 1. The proposed location of the conditional use and the amended conditions under which it will be operated and maintained will not be detrimental to the public health, safety, or general welfare, or be materially injurious to the properties or improvements in the vicinity. 2. The proposed conditional use amendment complies with the goals, objectives, and policies of the City's adopted General Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That Standard Condition No. 6, of Planning Commission Resolu- tion No. 481, is hereby amended to read as follows: Prior to a Final Occupancy Permit being authorized by the Department of Environmental Services, the property owner shall enter into a Record Agreement acceptable to the City Attorney and running with the land, to voluntarily be a part of any undergrounding district which is subsequently established by the City which includes the subject property within its proposed boundaries. All service lines to the new structure on the site shall be placed underground as a part of con- struction.
