A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, APPROVING A TIME EXTENSION FOR
A CONDITIONAL USE PERMIT TO CREATE AN INDUSTRIAL PLANNED
UNIT DEVELOPMENT AT THE SOUTHEAST CORNER OF COOK STREET
AND HOVLEY LANE.
CASE NO. CUP 15-78
WHEREAS, pursuant to the provisions of the Palm Desert Zoning
Ordinance, the Planning Commission of the City of Palm Desert, California,
did on the 3rd day of January, 1980, hold a duly noticed Public Hearing to
consider the application of GEORGETOWN PARK LTD./E. GEORGE MARZICOLA for
approval of a one year time extension for a Conditional Use Permit to
create a 42 lot Industrial Planned Unit Development on approximately 34.7
acres within the S.I., S.P. (Service Industrial, Scenic Preservation
Overlay) zone at the southeast corner of Cook Street and Hovley Lane,
more particularly described as:
APN 619-060-016-3
WHEREAS, said applicant has complied with the requirements of
the City of Palm Desert Environmental Quality Procedure Resolution No. 78-32
in that the subject project has been previously assessed under C/Z 11-78 and
no further evaluation is deemed necessary; and,
WHEREAS, at said Public Hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be
heard, said Commission did find the following facts and reasons to exist to
justify the granting of said Conditional Use Permit time extension:
1. The proposed use is a valid conditional use permitted
within the zoning district in which it was permitted.
2. The proposed use as amended by the original conditions
of approval will not adversely effect the public
health, safety, or general welfare or be materially
injurious to properties or improvements in the vicinity.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Palm Desert as follows:
1. That the above recitations are true and correct and
constitute the findings of the Commission in these
cases.
2. That a one year extension of time for Conditional Use
Permit 15-78 is hereby granted for reasons, subject to
the fulfillment of the original conditions of approval
in Planning Commission Resolution No. 433.
PASSED, APPROVED and ADOPTED at a meeting of the Palm Desert Plan-
ning Commission held on the 3rd day of January, 1980, by the following vote,
to wit:
AYES: Berkey, Miller, Snyder
NOES: None
ABSENT: Kryder
ABSTAIN: None
