HomeMy WebLinkAboutRes No 567PLANNING COMMISSION RESOLUTION NO. 567 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND DECLARING A COMMISSION POLICY RELATIVE TO THE REVIEW AND CONSIDERATION OF TENTATIVE SUBDIVISION MAPS, AND OTHER MATTERS RELATED THERETO. WHEREAS, Title 26 of the Palm Desert Municipal Code (Subdivision Ordinance) requires the Planning Commission to conduct a Public Hearing to consider Tentative Maps, as submitted by subdividers, for purpose of reporting to the City Council on their recommendation as to approval, conditional approval or dissapproval; and, WHEREAS, a Tentative Map recommended for approval must contain the number, size and configuration of lots to be created and the alignment and width of streets and easements, as required by the said Title 26; and, WHEREAS, the City Council must find that a Final Map is in conformance with a Tentative Map, prior to their action approving a Final Map, pursuant to the provisions said Title 26, found in Chapter 24 thereof; and, WHEREAS, the Planning Commission is additionally charged by Title 25 of the Palm Desert Municipal Code (Zoning Ordinance) to review and take final action on requests for initial plot plan approval, forwarded to Commission by the City Design Review Board; and, WHEREAS, the provisions of said Title 25, require specific exhibits detailing uses and features of proposed developments, to be submitted through the Design Review process to establish a final plan of construction; and, WHEREAS, in consideration of its duties and responsibilities, and the procedures and processes of the City noted herein, and further defined in the Municipal Code of the City of Palm Desert, California, the Planning Commission does find as follows: 1. That the Planning Commission is unable to properly fulfill its responsibility for report and recommendation to the City Council on a Tentative Map, which seeks to implement a conceptual Development Plan that has not received a detailed and precise design evaluation through the Design Review process. 2. That the establishment of precise plan of development is a necessary prerequisite for a Commission recommendation, on a Tentative Map which specifies the number, size and configuration of lots to be created and the alignment and width of streets and easements. 3. That approval of a Tentative Map, without benefit of plans approved through the Design Review process, may prove to constrain and bias a subsequent Design Review evaluation, and result in a disservice to the objectives of that process, because key site design features are specified as a part of the subdivision. NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitation are true and correct and constitute the findings and evaluation of the Commission in consideration of this matter. 2. That as a condition of Tentative Map application acceptance, the Director of Environmental Services is requested to require the submittal of a subdivision building or development plan (pursuant to Municipal Code Section 26.20.050A) for which an initial plan has been approved through the Design Review process, where it is the design and intention of the subdivision to implement a specific plan of development. FURTHER BE IT RESOLVED that it shall be a Planning Commission Policy to use said approved Design Review Plans in their consideration of Tentative Maps, to determine if map features conform to the approved plans.
