HomeMy WebLinkAboutRes No 580PLANNING COMMISSION RESOLUTION NO. 580 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ASSUMING AUTHORITY OVER A DESIGN REVIEW CASE, AND CONDITIONALLY APPROVING SAID CASE. CASE NO. 202 MF WHEREAS, the City Design Review Board did consider the application of PALM DESERT VENTURE LTD., applicant, at their meeting of February 26, 1980, and did deny said application; and, WHEREAS, said applicant did file a timely appeal of the Design Review Board action, requesting the City Planning Commission to assume authority over the case; and, WHEREAS, the Planning Commission did at their March 4, 1980, meeting consider the merits of the case along with additional justification provided by the applicant, and did elect to assume authority over the case; and, WHEREAS, the Planning Commission did at said meeting find the following facts and reasons to justify approval of the Design Review case: a. The intent and spirit of the adopted Design Review criteria will be observed by the gate facility as modified. b. The conditions under which the gate facility will be operated, will substantially insure safe, convenient access. NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this matter. 2. That the Planning Commission does hereby approve Design Review Case No. 202 MF (Exhibit A) subject to those conditions attached hereto. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 4th day of March, 1980, by the following vote, to wit: AYES: BERKEY, KRYDER, MILLER, SNYDER NOES: NONE ABSENT: NONE ABSTAIN: NONE dier47) WALTER SNYDER, Chairma ATTEST: PAUL A. WILLIAMS, Secretary /1r PLANNING COMMISSION RESOLUTION NO. 580 Page -2- SPECIAL CONDITIONS 1. The security gate shall only be used during the night hours to deter easy access to the project, or when manned. 2. There shall be a 24 hour PBX phone coverage or guard to open the gate. 3. A security guard shall be on duty during the night to man the gate for vehicles larger than a long -wheel based van or truck. These vehicles will be allowed to enter the project where they can use a four-way intersection to turn around. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow occu- pancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services.
