HomeMy WebLinkAboutRes No 587PLANNING COMMISSION RESOLUTION NO. 587 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A DEVELOPMENT PLAN TO ALLOW CONSTRUCTION OF 156 RESIDENTIAL UNITS, RECREATIONAL AMENITIES AND OPEN SPACE AND RELATED DESIGN REVIEW APPLICATION ON APPROX- IMATELY 34.06 GROSS ACRES AT THE NORTHEAST CORNER OF HOVLEY LANE (EXTENDED) AND COOK STREET. CASE NO. DP 04-80 and 204 MF WHEREAS, the Planning Commission of the City of Palm Desert, California, did hold a duly noticed Public Hearing on April 1, 1980, to consider a request by J.M. PETERS COMPANY to allow construction of 156 residential units, related recreational amenities and open space and related design review application, on approximately 34.06 gross acres within the PR-5, S.P. (Planned Residential, max. 5 d.u./acre, Scenic Preservation Overlay) zone at the northeast corner of Hovley Lane (extended) and Cook Street, more particularly described as: Parcel No. 1 of Parcel Map 13406 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32," in that the Director of Environmental Services has determined that this project will not have a significant adverse effect on the environment and the appeal period has expired; and, WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, the Planning Commission did find the following facts and reasons to exist to justify the approval of the subject Development Plan and Preliminary Design Review: 1. The proposed development is consistent with the City's adopted General Plan. 2. The proposed use is similar to and compatible with those contemplated on nearby properties. 3. The design or improvements of the proposed development will be consistent with the Palm Desert Zoning Ordinance. 4. The site is physically suited for both the type of develop- ment proposed and the proposed density. 5. The design of the development and the proposed improvements are not likely to cause substantial environmental damage or have a serious effect on the public health, safety, or general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and consti- tute the findings of the Planning Commission in this case. 2. The Planning Commission does hereby approve Development Plan DP 04-80 and 204 MF for reasons stated, subject to conditions. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 1st day of April, 1980, by the following vote, to wit: AYES: Berkey, Kryder, Miller, Snyder NOES: None ABSENT: None ABSTAIN: None ATTEST: PAUL A. WILLIAMS, Secretary PLANNING COMMISSION RESOtUTION NO. 587 Page -2- CONDITIONS OF APPROVAL CASE NO. DP 04-80 AND 204 MF Standard Conditions: 1. The development of the property shall conform substantially with Exhibit A-K (Case No. DP 04-80) on file with the Department of Environmental Services, as modified by the following conditions. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval, the applicant shall first complete all the procedural requirements of the City which include, but not limited to, Design Review, Subdivision process, and building permit procedures. 3. Construction of the total development may be done in phases; however, each individual phase shall meet or exceed all Municipal Code requirements to the degree that the City could consider each phase as a single project. 4. Construction of a portion of said project shall commence within one year from the date of final approval otherwise said approval shall become null, void and of no effect whatsoever. Further, the total project shall be completed by January 1, 1987. After said date, this approval shall auto- matically expire for those remaining undeveloped portions of the subject property and the City Council may initiate rezoning procedures to revert said undeveloped areas to an S (Study) Zone designation,. 5. Prior to the issuance of any City permits for the commencement of construc- tion on said project, the applicant shall agree in writing to these conditions of approval. 6. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and State and Federal Statutes now in force, or which hereafter may be in force. 7. All existing electrical distribution lines, telephone, cable antenna television, and similar service wires or cables, which are adjacent to the property being developed shall be installed underground as a part of development from the nearest existing pole not on the property being developed. 8. All requirements of the City Fire Marshal shall be met as part of the development of this project per attached letter dated March 18, 1980. 9. Construction plans shall be submitted for approval to the City Fire Marshal prior to issuance of building permits. All conditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. 10. Traffic control provisions shall be provided as required by the Director of Public Works. 11. Curb, gutter, sidewalk or approved pathways, and tie-in paving shall be provided in conformance with City Standards and/or as required by the Director of Public Works. 12. Prior to issuance of a building permit for construction of any use con- templated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Design Review Board Process City Fire Marshal Coachella Valley County Water District Evidence of said permit or clearance from the above agencies shall be presented to the Department of Building and Safety at the time of issuance of a building permit for the use contemplated herewith. 13. No development shall occur on the subject property prior to recordation of a tract map. PLANNING COMMISSION RESOLUTION NO. 587 Page -3- SPECIAL CONDITION 1. Secondary access shall be provided to Via Cinta. DESIGN REVIEW CONDITIONS A. Site Plan 1. The proposed perimeter wall shall be extended for the full length of the northerly boundary of the project. 2. Details shall be submitted as a part of the working drawings for all walls, walks and special materials. 3. The stamped pavement treatment shall be utilized at the main entrance to the project. 4. All driveway aprons shall be concrete. 5. All units shall have a minimum 320 square foot private yard area. All units with private yards facing south or west shall have increased overhangs or patio covers. 6. Show air-conditioning pad locations on final landscaping plans and how screening will be achieved. 7. For driveways without 20 foot aprons, open parking spaces shall be provided adjacent to said driveways. B. Landscape Plan 1. The proposed eucalyptus is not approved. The applicant shall submit an alternative acceptable to the Board as a part of construction drawings. 2. Delete Cercidium Fioridum, Chilopsis Linearis, Eugenia Myrtifolia, and Grevillea Noellii and provide acceptable alternative with construction drawings. C. Building Elevations 1. As a part of construction drawings, the applicant shall submit plans for all miscellaneous buildings, such as guard houses, storage build- ings, recreation -related shade structures and buildings. 2. The applicant shall utilize solar panels for all pools and shall incorporate said panels into the recreation area. 3. Prior to submission of final construction drawings, the applicant shall submit to the Design Review Board iterim plans to show how shading of glass areas will be achieved. Install a water system capable of delivering 2500 GPM fire flow for a two (2) hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular traval ways. Hydrant spacing not to exceed 500 feet. A. Hydrants shall not be located closer than 25 feet to any building. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. C. Curbs (if installed) shall be painted red 15 feet in either direction from each hydrant. 3. Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. Upon approval, one copy will be sent to the Building Department and the original will be returned to the developer. PLANNING COMMISSION RESOLUTION NO. 587 Page -z- Paul A. The water system plan shall be signed by a registered civil engineer, and approved by the water company, with the following certification: " I certify that the design of the water system in Case Number DP 04-80 is in accordance with the requirements prescribed by the Fire Marshal." 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Alternate access to this site shall be provided. 7. No cul-de-sac shall exceed 700 feet in length. 8. Parking shall be allowed only on one side of all 32 foot streets. Sincerely, DAVID L.
