A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, DENYING WITHOUT PREJUDICE A
CONDITIONAL USE PERMIT AND VARIANCE TO ALLOW THE REHA-
BILITATION OF EXISTING BUILDING AND CONSTRUCTION OF AN
OFF -SITE PARKING LOT LOCATED AT THE NORTHWEST CORNER
OF THE INTERSECTION OF PORTOLA AVENUE AND NORTH PALM
DESERT DRIVE AND THE NORTHEAST CORNER OF SAN JACINTO
AVENUE AND ALESSANDRO DRIVE.
CASE NOS. CUP 04-80 and VAR 04-80
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 3rd day of June, 1980, hold a duly noticed Public Hearing to consider a
request by MR. BILL GUENTHER for approval of a Conditional Use Permit and Variance
to allow the rehabilitation of existing building for a 4,889 square foot restaur-
ant and 2,000 square feet of office space and construction of on and off site
parking area with a Variance to reduce the required parking from 82 spaces to 61
spaces, and deviations from parking lot and landscape standards within the C-1,
S.P. (General Commercial, Scenic Prservation Overlay) and R-3(4) (Multi -Family,
minimum 4,000 square foot per dwelling unit) zones, generally located at the
northwest corner of the intersection of Portola Avenue and North Palm Desert Drive
and the northeast corner of San Jacinto Avenue and Alessandro Drive, more particu-
larly described as:
LOTS 7, 8, 9, PALMA VILLAGE UNIT #6 and
Portion of LOT 7 and LOTS 8, 9, 19, PALMA VILLAGE UNIT #1
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Environmental Quality Procedure Resolution No. 78-32", in that the
Director of Environmental Services has determined that the project will not have a
significant adverse impact on the environment and a Negative Declaration has been
prepared.
WHEREAS, at said Public Hearing, upon hearing and considering all testi-
mony and arguments, if any, of all interested persons desiring to be heard, said
Planning Commission did find the following facts to justify their actions, as
described below:
a. The City Council has determined that the structure on the property
is a public nuisance and has awarded a bid to demolish said structure.
b. The applicant, in light of the City Council action, has verbally
stated that he would withdraw his request.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the Commission in this case.
2. That the Planning Commission does hereby deny without prejudice
Conditional Use Permit No. 04-80 and Variance No. 04-80 for the
reasons stated above.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 3rd day of June, 1980, by the following vote, to
wit:
AYES: Berkey, Kryder, McLachlan, Miller, Richards

ABSENT: None
ABSTAIN: None
