HomeMy WebLinkAboutRes No 606PLANNING COMMISSION RESOLUTION NO. 606 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING APPROVAL TO THE CITY COUNCIL OF AN AMENDMENT TO THE ZONING ORDINANCE TEXT, RELATING TO OPEN HOUSE DIRECTIONAL SIGNS. ZOA 03-80 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 3rd day of June, 1980, hold a duly noticed Public Hearing, to consider amendment of the Zoning Ordinance relative to open house directional signs; WHEREAS, said amendment has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32," in that the subject project has not been found to present an adverse impact on the environment and a Negative Declaration has been prepared; and, WHEREAS, at said Public Hearing, upon hearing and considering all testi- mony and arguments, if any, of all persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to recommend approval of a modified Zoning Ordinance Text Amendment: 1. That the Modified Zoning Ordinance Amendement is consistent with the objectives of the Zoning Ordinance. 2. That the Modified Zoning Ordinance Amendement is consistent with the adopted General Plan. 3. That the Modified Zoning Ordinance Amendment would better serve the public health, safety and general welfare than the current applicable regulations. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. That it does hereby recommend a Modified Zoning Ordinance Text Amendment, as provided in the attached Exhibit, labeled Exhibit "A", to amend Municipal Code, Section 25.68.150, specifying regulations for Real Estate Open House Signs, and other matters relating thereto. PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 3rd day of June, 1980, by the following vote, to wit: AYES: BERKEY, KRYDER, MCLACHLAN, RICHARDS, MILLER NOES: NONE ABSENT: NONE ABSTAIN: NONE 2 CHARL ILL R, Chairman ATTEST: /1r PLANNING COMMISSION RESOLUTION NO. 606 Page Two EXHIBIT "A" 25.68.150 Open House Signs. During the period under which real estate is offered for sale or lease and while a salesperson is physically present on the premises, a sign indicating open house shall be permitted. The sign shall not exceed three square feet in area; and, if located on a pole, no part of the sign or pole area shall exceed four feet above ground level. Off -site directional signs may be permitted for an open house, subject to the following provisions: A. Each sign shall not exceed three square feet; B. No flags or banners shall be used; C. To be located on private property only, -unless, prior written approval for unique circumstances rs obtained from the Director of Environmental Services. D. Limited to two signs unless prior written approval for unique circumstances is obtained from the Director of Environmental Services.
