HomeMy WebLinkAboutRes No 613PLANNING COMMISSION RESOLUTION NO. 613 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A DEVELOPMENT PLAN TO ALLOW THE CONSTRUCTION OF A COMMERCIAL COM- PLEX GENERALLY LOCATED AT THE SOUTHEAST CORNER OF THE INTERSECTION OF EL PASEO AND HIGHWAY 111. CASE NO. DP 06-80 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 3rd day of June, 1980, hold a duly noticed Public Hearing and continued Public Hearing on June 18, and July 1, 1980, to consider a request by GERALD J. CHAZAN for approval of a Development Plan to allow the construction of 71,200 square feet of commercial space on approximately 7.23 gross acres within the PC(3), S.P. (Planned Commercial, Regional Center, Scenic Preservation Overlay) zone generally located at the southeast corner of the intersection of El Paseo and Highway 111, more particularly described as: Parcel 1, Parcel Map No. 14647 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32", in that the Director of Environmental Services has determined that the project has previously been assessed in connection with Case Nos. DP 15-78 and VAR 05-78, and no further documentation is deemed necessary. WHEREAS, at said Public Hearing, upon hearing and considering all testi- mony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts to justify their actions, as described below: a. The proposed project generally conforms to the intent and purpose of the PC(3) Zone District. b. The proposed project is adequately suited for the specific site and is compatible with existing and proposed development in the area. c. The proposed project will not be detrimental to the health, safety and general welfare of the community. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. That the Planning Commission does hereby approve Conceptual Develop- ment Plan No. 06-80, subject to those conditions attached hereto. WILLIAMS, Secretary oar Sow PLANNING COMMISSION RESOLUTION NO. 613 Page Two CONDITIONS OF APPROVAL CASE NO. DP 06-80 Standard Conditions: 1. The development of the property shall conform substantially with Exhibit A (Case No. DP 06-80, dated June 26, 1980) on file with the Department of Environmental Services, as modified by the following conditions. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval, the applicant shall first complete all the procedural requirements of the City which include, but are not limited to, Design Review, Subdivision process, and building permit procedures. 3. Construction of all site improvements shall be done in one phase, except for the actual buildings themselves. 4. Construction of a portion of said project shall commence within one year from date of final approval otherwise said approval shall become null, void, and of no effect whatsoever. 5. Prior to the issuance of any City permits for the commencement of construction on said project, the applicant shall agree in writing to these Conditions of Approval. 6. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in additions to all Municipal Ordinances and State and Federal Statutes now in force, or which hereafter may be in force. 7. All existing electrical distribution lines, telephone,cable antenna television, and similar service wires or cables, which are adjacent to the property being developed shall be installed underground as a part of development from the nearest existing pole not on the property being developed. 8. All requirements of the City Fire Marshal shall be met as a part of the devel- opment of this project per attached letter dated May 22, 1980. 9. Construction plans shall be submitted for approval to the City Fire Marshal prior to issuance of building permits. All conditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. 10. Traffic control provisions shall be provided as required by the Director of Public Works. 11. Curb, gutter, sidewalk or approved pathways, and tie-in paving shall be pro- vided in conformance with City Standards and/or as required by the Director of Public Works. 12. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Design Review Board Process City Fire Marshal Coachella Valley County Water District Evidence of said permit or clearance from the above agencies shall be presented to the Department of Building and Safety at the time of issuance of a building permit for the use contemplated herewith. PLANNING COMMISSION RESOLUTION NO. 613 Page Three Special Conditions: 1. Herein granted is an exception from Municipal Code Section 25.30.230, Paragraph E, for that portion of the frontage along El Paseo beginning at the westerly driveway entrance (at Painters Path) and continuing east to a point 35 feet west of the eastern property line, to the extent that the depth of landscaping may be reduced to not less than ten (10) feet. Also granted is an adjustment from Municipal Code Section 25.30.130, to the extent that an 8.2% variance from the number of required parking spaces is permitted based on a maximum building area of 71,200 sq. ft. No other exceptions or adjustments are contemplated or authorized by this approval. 2. The Conceptual Site Plan shall be redesigned to satisfy the following item, before plans are filed for the Design Review Process: a. The westerly driveway entrance to El Paseo shall be designed as approved by the Director of Public Works. 3. Any high traffic generation uses, such as restaurants, subsequently proposed to be located in buildings along the southerly parking area shall specifically be submitted to the Planning Commission for consideration. 4. The project shall be developed with a unified architectural theme, the use of two or more conflicting architectural approaches shall be prohibited. 5. The Design Review Process shall pay specific attention to: a. A unifying architectural, business identification sign and landscape design. b. Other design features and techniques which may be utilized to enhance the design of the project as an integral unit. c. Interim landscape ground covers for building pads not developed as a part of the first phase. d. Landscaping of median islands required to be developed as a part of this project. e. Screening of vehicles from El Paseo. f. Parking lot lighting to eliminate glare from any boundary. 6. The development shall comply with all requirements of Parcel Map No. 14647, and design of public right of way improvements shall be as specified by the Director of Public Works. 7. The final drainage plan shall be subject to the review and approval of the Director of Public Works, with specific attention given to the requirements of the State Division of Highways (CALTRANS) for waters accumulating in the intersection of El Paseo and Highway 111. 8. The developer shall install a raised landscaped center median on El Paseo between Highway 111 and Painters's Path as approved by the Director of Public Works. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow occupancy in the use permitted unitl this signed confirmation has been received by the Department of Environmental Services. Install a water system capable of delivering 3000 GPM fire flow for a three (3) hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. A. Hydrants shall not be located closer than 25 feet to any building. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. C. Curbs (if installed), shall be painted red 15 feet in either direction from each hydrant. 3. Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. Upon approval, one copy will be sent to the Building Department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer, and approved by the water company, with the following certification: "I certify that the design of the water system in Case Number DP 06-80 is in accordance with the requirements prescribed by the Fire Marshal." Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6.
