HomeMy WebLinkAboutRes No 614PLANNING COMMISSION RESOLUTION NO. 614 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A DEVELOPMENT PLAN AMENDMENT TO MODIFY A SPECIAL CONDITION FOR A 30 UNIT PLANNED RESIDENTIAL DEVELOPMENT LOCATED ON THE WEST SIDE OF DEEP CANYON ROAD, 250 FEET NORTH OF 44TH AVENUE. CASE NO. DP 21-78 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 1st day of July, 1980, hold a duly noticed Public Hearing to consider a request by ROMAN CATHOLIC BISHOP OF SAN BERNARDINO, SACRED HEART CHURCH, PALM DESERT, CALIFORNIA, for approval of a Development Plan Amendment to modify a special condition requirement for a masonry wall along the sides and rear of an eight acre 30 unit Planned Residential Development within the PR-4 (Planned Resi- dential, max. 4 d.u./ac.) zone generally located on the west side of Deep Canyon Road, 250 feet north of 44th Avenue, more particularly described as: APN 621-471-002, 621-440-005 Portion of 621-472-017 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32", in that the Director of Environmental Services has determined that the project has previously been assessed in connection with Case No. DP 21-78, original approval, and no further documentation is deemed necessary. WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts to justify their actions, as described below: a. The proposed project, with modified condition, generally conforms to the intent and purpose of the PR Zone District. b. The proposed project, with modified condition, is adequately suited for the specific site and is compatible with existing and proposed development in the area. c. The proposed project, with modified condition, will not be detrimental to the health, safety and general welfare of the community. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. That the Planning Commission does hereby approve amendment to the requirement for site boundary walls for DP 21-78, subject to conformance with Exhibit "A", attached hereto. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 1st day of July, 1980, by the following vote, to wit: AYES: NOES: ABSENT: ABSTAIN: BERKEY, KRYDER, MCLACHLAN, RICHARDS, MILLER NONE NONE NONE CHARLES MIL ER, Chairman PAUL A. WILLIAMS, Secretary PLANNING COMMISSION RESOLUTION NO. 614 Page Two EXHIBIT "A" .40 The treatment along the south and east boundaries is found acceptable as it now exist. A six foot high solid masonry wall shall be installed from the southwest corner of the project northerly to a point approximately 204 feet, then westerly approximately 99.6 feet and then approximately 25 feet northerly. The existing hedge landscaping remaing on the westerly and northerly property lines shall be maintained in perpetuity.
