A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
PALM DESERT, CALIFORNIA, APPROVING A DEVELOPMENT PLAN TO
ALLOW A FIRE STATION AND STORM WATER RETENTION BASIN/OPEN
SPACE AREA ON EAST SIDE OF EL PASEO (EXTENDED) APPROXI-
MATELY 1,300 FEET NORTH OF HIGHWAY 111.
CASE NO. DP 08-80
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 1st day of July, 1980, hold a duly noticed Public Hearing to consider
a request by ERNEST W. HAHN, INC. for approval of a Development Plan to allow a fire
station and storm water retention basin/open space area on approx. 1.78 acres, with-
in the PR-6, S.P. (Planned Residential, max. 6 d.u./ac., Scenic Preservation Overaly)
zone generally located on the east side of El Paseo (Extended) approximately 1,300
feet north of Highway 111, more particularly described as:
Portion of APN 629-030-004
WHEREAS, said application has complied with the requirements of the
"City of Palm Desert Environmental Quality Procedure Resolution No. 7832", in
that the Director of Environmental Services has determined that the project has
previously been assessed in connection with Case Nos. C/Z 08-79, DP 12-79 and
CUP 06-79 and no further documentation is deemed necessary.
WHEREAS, at said Public Hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be
heard, said Planning Commission did find the following facts to justify their
actions, as described below:
a. The proposed project generally conforms to the intent
and purpose of the PR Zone District.
b. The proposed project is adequately suited for the
specific site and is compatible with existing and
proposed development in the area.
c. The proposed project will not be detrimental to the
health, safety and general welfare of the community.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of Palm Desert, California, as follows:
1. That the above recitations are true and correct and
constitute the findings of the Commission in this case.
2. That the Planning Commission does hereby approve
conceptual Development Plan No. 08-80 (Exhibit A) subject
to those conditions attached hereto.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 1st day of July, 1980, by the following
vote, to wit:

CONDITIONS OF APPROVAL
CASE NO. DP 08-80
Standard Conditions:
1. The development of the property shall conform substantially with Exhibit
A (Case No. DP 08-80) on file with the Department of Environmental
Services, as modified by the following conditions.
2. Prior to the issuance of a building permit for construction of any
uses contemplated by this approval, the applicant shall first complete
all the procedural requirements of the City which include, but are not
limited to, Design Review, Subdivision process, and building permits
procedures.
3. Construction of the total development may be done in phases; however,
each individual phase shall meet or exceed all Municipal Code require-
ments to the degree that the City could consider each phase as a
single project.
4. Construction of a portion of said project shall commence within one
year from the date of final approval otherwise said approval shall
become null, void and of no effect whatsoever.
5. Prior to the issuance of any City permits for the commencement of
construction on said project, the applicant shall agree in writing to
these Conditions of Approval.
6. The development of the property described herein shall be subject to
the restrictions and limitations set forth herein which are in addition
to all municipal ordinances and State and Federal Statutes now in force,
or which hereafter may be in force.
7. All existing electrical distribution lines, telephone, cable antenna
television, and similar service wires or cables, which are adjacent
to the property being developed shall be installed underground as a
part of development from the nearest existing pole not on the property
being developed.
8. Traffic control provisions shall be provided as required by the Director
of Public Works.
9. Curb, gutter, sidewalk or approved pathways, and tie-in paving shall be
provided in conformance with City Standards and/or as required by the
Director of Public Works.
10. Prior to issuance of a building permit for construction of any use
contemplated by this approval, the applicant shall first obtain permits
and/or clearance from the following agencies:
Riverside County Department of Health
Palm Desert Design Review Board Process
City Fire Marshal
Coachella Valley Water District
Evidence of said permit or clearance from the above agencies shall be
presented to the Dept. of Building and Safety at the time of issuance
of a building permit for the use contemplated herewith.
11. No development shall occur on the subject property prior to the record-
ation of a revision to PM 15723.

SPECIAL CONDITIONS
1. The retention basin shall be designed to retain a minimum of a one hundred
(100) year storm intensity volume originating on the ± 62 acre shopping center `S
site. All work required in this condition shall be subject to the approval of
the City Director of Public Works, based upon hydrologic calculations sub-
mitted by the applicant's engineer.
2. The fire station site, as defined in the Fire Departments letter dated July 1,
1980, shall be offered to the City as a dedication.
3. Perimeter screening of the site to the north, east and west shall specifically
be submitted for the Design Review Process.
4. Precise design of the fire station site when developed shall be submitted to
the Design Review Board and their action forwarded to the Planning Commission
for confirmation.
AGREEMENT
I accept and agree, prior to use of this permit or approval, to comply with all
the conditions set forth, and understand that the Department of Building and
Safety will not issue a building permit or allow occupancy on the use permitted
until this signed confirmation has been received by the Department of Environmental
Services.

After meeting with Mr. Ray Gamble to discuss the proposed fire station site
at the Hahn Center in Palm Desert, we submit the following:
The 185' by 250', with clipped corner site, as shown on supplemental site
plan X-41, dated June 27, 1980, of general site plan S-1 , as submitted to
the city and prepared by Millard Archuleta and Associates, is acceptable,
provided,
a. The internal identified measurements of the actual fire station
facility can be changed to better suit the needs of the fire
department;
b. A continuing one-way traffic flow pattern can be established on the
fire station site;
c. The parking areas can be adjusted;
d. That representatives from the fire department are given adequate
opportunity to meet with the design architect prior to drawings
being initiated, and
e. That the fire department have the opportunity for additional input as
the plans proceed.
The concept of a two story facility office and living space is acceptable;
again, provided there is ample input prior to final internal design.
Basically, what needs to be said is, we accept the site but have identified
many changes that will be necessary to make it suit fire department needs.
There is adequate room and the capability exists to make these changes without
additional acreage.

This, approval is contingent upon three items that need to be solved by the
City of Palm Desert and Hahn Development Corporation;
1. The traffic signal capable of being controlled at the fire station
must be installed at the intersection of State Highway 111 and El Paseo;
2. El Paseo needs to be extended in a northerly direction to intersect with
Avenue 44, or some other cross street, with a controlled signal device
provided, as traffic flow warrants. This is necessary for access to the
residential and College of the Desert areas, without competing with
Highway 111 traffic.
3. A one light signal device to stop vehicles exiting the Hahn parking area,
midway, between Highway 111 and the proposed fire station site. The exit
adjacent to the fire station site, immediately to the south, does not
appear to need a traffic control device, since it is an employee parking
area.
