A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM
DESERT, CALIFORNIA, APPROVING A SECOND AMENDMENT TO A PRE-
VIOUSLY APPROVED DEVELOPMENT PLAN TO ALLOW A 4184 SQ. FT.
RESTAURANT USE IN A PORTION OF A COMMERCIAL COMPLEX ON
APPROXIMATELY 3.5 ACRES, WITHIN THE P.C. (3), S.P. (PLANNED
COMMERCIAL, SCENIC PRESERVATION OVERLAY) ZONE GENERALLY
LOCATED AT THE SOUTHWEST CORNER OF HIGHWAYS 74 AND 111.
CASE NO. DP 02-78 (AMENDMENT)
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 19th day of September, 1979, hold a duly noticed Public Hearing, and
continued Public Hearings on the 5th day of August, 1980, to consider a request by
COLUMBIA SAVINGS AND LOAN for approval of an amendment to a previously approved
Development Plan to allow a 4184 sq.ft. restaurant use in a portion of a commercial
complex on approximately 3.5 acres, within the P.C. (3), S.P. (Planned Commercial,
Regional; Scenic Preservation Overlay) zone generally located at the southwest corner
of Highways 74 and 111, more particularly described as:
APN 629-072-018
WHEREAS, said applicant has complied with the requirements of the "City
of Palm Desert Procedure for Implementation of the California Environmental Quality
Act, Resolution No. 80-89", in that the Director of Environmental Services has
determined that the project has previously been assessed in connection with Case
No. DP 02-78 (Original Request), and no further documentation is deemed necessary.
WHEREAS, at said Public Hearing, upon hearing and considering all testimony
and arguments, if any, of all interested persons desiring to be heard, said Planning
Commission did find the following facts to justify their actions, as described below:
a. The proposed project amendment generally conforms to the intent
and purpose of the PC Zone District.
b. The proposed project amendment is adequately suited for the specific
site and is compatible with existing and proposed development in the
area.
c. The proposed project amendment will not be detrimental to the health,
safety and general welfare of the community.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the Commission in this case.
2. That the Planning Commission does hereby approve a second amendment
to the list of uses permitted in the development of (Case No. DP 02-78),
to include a second restaurant containing 4184 sq.ft., subject to
compliance with all of the conditions originally imposed in Planning
Commission Resolution No. 392.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 5th day of August, 1980, by the following vote,
to wit:
AYES: BERKEY, RICHARDS, MILLER
NOES: NONE
ABSENT: KRYDER, MCLACHLAN
ABSTAIN: NONE
