A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM
DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND GRANTING A ONE-
YEAR TIME EXTENSION FOR IMPLEMENTATION OF A PLANNED RESIDENTIAL
(APARTMENT) DEVELOPMENT AND PRELIMINARY DESIGN REVIEW TO ALLOW
CONSTRUCTION OF SIXTY (60) APARTMENTS AND ASSOCIATED RECREATIONAL
AMENITIES ON APPROXIMATELY 10.87 ACRES WITHIN THE PR-5 (PLANNED
RESIDENTIAL, MAX. 5 D.U./AC.) ZONE LOCATED ON THE EAST SIDE OF
PORTOLA AVENUE, SOUTH OF THE WHITEWATER STORM CHANNEL.

WHEREAS, pursuant to the provision of the Palm Desert Zoning Ordinance,
the Planning Commission did on August 5, 1980, hold a duly noticed Public Hearing
to consider the application of TRANSCOPIC DEVELOPMENT CORPORATION for approval of
a time extension for a Planned Residential (Apartment) Development and Preliminary
Design Review Case to allow construction of sixty (60) apartments and associated
recreational amenities on approximately 10.87 acres within the PR-5 (Planned
Residential max. 5 d.u./ac.) zone located on the east side of Portola Avenue, south
of the Whitewater Storm Channel, more particularly described as:
APN 621-400-022
WHEREAS, said applicant has complied with the requirements of the "City
of Palm Desert Environmental Quality Procedure Resolution No. 78-32", (now super-
seded by Resolution No. 80-89) in that the Director of Environmental Services has
determined that the project will not have a significant adverse effect on the
environment and a Negative Declaration has been filed in connection with the ori-
ginal application; and,
WHEREAS, at said Public Hearing, upon hearing and considering all testimony
and argument, if any, the Planning Commission did find the following facts and reasons
to exist to justify approval of said Development Plan and Preliminary Design Review
time extensions:
1. The location of the project is in accord with the objectives of the
Zoning Ordinance and the purpose of the district in which the site
is located.
2. The location of the proposed use and the conditions under which it
would be operated or maintained will not be detrimental to the
public health, safety, or welfare, or be materially injurious to
properties or improvements in the vicinity.
3. The proposed use will comply with each of the applicable provisions
of the Zoning Ordinance.
4. The proposed use complies with the goals, objectives, and policies
of the City's General Plan.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the Commission in these cases.
2. Approval of a one year extension of time for implementation of the
Development Plan and Preliminary Design Review is granted to TRANS-
COPIC DEVELOPMENT CORPORATION subject to the conditions contained
in Planning Commission Resolution No. 505, the requirements of the
Fire Marshal's letter, attached hereto, dated July 16, 1980, and
conformance to any subsequently adopted Circulation Element policy,
with implementation approval granted herein not permitted until that
policy has been adopted.
PASSED, APPROVED and ADOPTED at a regular meeting of the City of Palm
Desert Planning Commission held on this 5th day of August, 1980, by the following
vote, to wit:
