HomeMy WebLinkAboutRes No 637PLANNING COMMISSION RESOLUTION NO. 637 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A ONE YEAR TIME EXTENSION OF AN APPROVED PRELIMINARY DEVELOPMENT PLAN TO ALLOW CONSTRUCTION OF 116 CONDOMINIUM UNITS ON THE SOUTH SIDE OF COUNTRY CLUB DRIVE, BETWEEN MONTEREY AVENUE AND PORTOLA AVENUE. CASE NO. DP 10-79 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 17th day of September, 1980, hold a duly noticed Public Hearing to consi- der a request by MACK DEVELOPMENT AND INVESTMENT CO. for approval of a one year time extension of an approved preliminary Development Plan to allow construction of 116 residential condominium units on approximately 25 acres within the PR-5 (Planned Residential, max. 5 d.u./ac.) zone located on the south side of Country Club Drive, between Monterey Avenue and Portola Avenue, more particularly described as: APN 621-190-005 621-190-006 621-190-007 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Services has determined that the project has previously been assessed in connection with Case No. DP 10-79 (original application) and no further documentaion is deemed necessary; and, WHEREAS, at said Public Hearing, upon hearing and considering all testi- mony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts to justify their actions, as described below: a. The proposed project generally conforms to the intent and purpose of the PR Zone District. b. The proposed project is adequately suited for the specific site and is compatible with existing and proposed development in the area. c. The proposed project will not be detrimental to the health, safety and general welfare of the community. d. The considerations relating to the original approval are still valid. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. That the Planning Commission does hereby approve a one year time extension of conceptual Development Plan No. 10-79 (Exhibit A) subject to those conditions contained in Planning Commission Resolution No. 523. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 17th day of September, 1980, by the following vote, to wit: AYES: NOES: ABSENT: ABSTAIN: BERKEY, KRYDER, MCLACHLAN, MILLER, RICHARDS NONE NONE NONE CHARLES MILLER, Chairman ATTEST; MURREL CRUMP, Acting Secretary /lr
