HomeMy WebLinkAboutRes No 639PLANNING COMMISSION RESOLUTION NO. 639 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND APPROVING A TENTATIVE PARCEL MAP TO DIVIDE APPROXIMATELY 29.29 ACRES INTO FOUR (4) PARCELS FOR FINANCING PURPOSES, WITHIN THE P.C. (4), S.P. ZONE ON PROPERTY LOCATED AT THE SOUTHWEST CORNER OF HIGHWAY 111 AND 44TH AVENUE. CASE NO. PM 16258 WHEREAS, the Planning Commission of the City of Palm Desert, California, did hold a duly noticed Public Hearing on May 14, 1980, and continued Public Hearing on June 3, July 1, August 5, September 2, and September 17, 1980, to consider a Tentative Parcel Map to divide 29.29 acres into four (4) parcels for financing purposes, within the P.C. (4), S.P. (Planned Commercial, Resort, Scenic Preservation Overlay) zone, on property located at the southwest corner of Highway 111 and 44th Avenue, more particularly described as: Tract 4489-1 and 4489-2 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to implement the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Services has determined that the project has been previously assessed in connection with the Redevelopment Plan and related Environmental Impact Report. WHEREAS, at said continued Public Hearing, upon hearing and considering the testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to justify approval of the Parcel Map: 1. The subject Tentative Parcel Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code and the State of California Subdivision Map Act, as amended. 2. The subject Tentative Parcel Map does comply with the adopted General Plan, the Palm Desert Zoning Ordinance and approved Development Plan and Variance for the site. 3. The site is physically suitable for the type of development proposed. 4. The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or serious health problems. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. That it does hereby approve the above described Tentative Parcel Map No. 16258 for financing purposes only, subject to fulfillment of the attached conditions. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 17th day of September, 1980, by the following vote, to wit: AYES: BERKEY, KRYDER, MCLACHLAN, MILLER, RICHARDS NOES: NONE ABSENT: NONE ABSTAIN: NONE ATTEST: MURREL CRUMP, Acting Secretary /lr PLANNING COMMISSION RESOLUTION NO. 639 Page Two CONDITIONS OF APPROVAL CASE NO. PM 16258 1. The Tentative Parcel Map is granted for financing purposes only for the land as described in the attachments hereto, and as shown on the map labeled Exhibit A, and the requirements herein. 2. All requirements of any law, ordinance, or regulation of the State, City and other applicable government entity, shall be complied with as a part of this map. 3. Applicant shall comply with all of the Conditions of Approval for related Case Nos. DP 03-80 and VAR 03-80 as a part of this approval for this Tentative Parcel Map, but no development of this site shall take place until a subsequent Final Tract Map is recorded.
