A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM
DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING A
VARIANCE FROM OFF-STREET PARKING REQUIREMENTS FOR A COMMERCIAL
BUILDING ON THE NORTH SIDE OF HIGHWAY 111, 300 FEET EAST OF
CABRILLO AVENUE.
CASE NO. VAR 07-80
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 30th day of September, 1980, hold a duly noticed Public Hearing to
consider a request by DON LINTON for approval of a Variance from off-street parking
standards to allow Protection Services Inc. to utilize a 4100 sq.ft. building as an
office (17 parking spaces required - 8 spaces provided) within a C-1, S.P. (General
Commercial, Scenic Preservation Overlay) zone located on the north side of Highway
111, 300 feet east of Cabrillo Avenue, more particularly described as:
APN 627-252-004 and 617-252-005
WHEREAS, said applicant has complied with the requirements of the "City
of Palm Desert Procedure for Implementation of the California Environmental Quality
Act, Resolution No. 80-89", in that the Director of Environmental Services has
determined that the proposed project will not have a significant adverse impact on
the environment and that a Negative Declaration has been prepared. Said Negative
Declaration is hereby approved by the Commission; and,
WHEREAS, at said Public Hearing, upon hearing and considering all testimony
and arguments, if any, of all interested persons desiring to be heard, said Planning
Commission did find the following facts to justify their actions, as described below:
a. The strict enforcement of the commercial parking requirements
would result in practical difficulty inconsistent with the
objectives of the Zoning Ordinance;
b. There are exceptional circumstances or conditions applicable to
this property uses that do not apply generally to other property
uses in the C-1, S.P. General Commercial, Scenic Preservation
Overlay, zone;
c. The strict enforcement of the commercial parking requirements
would deprive the applicant of privileges enjoyed by the
owners of other property in the C-1 zone.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute
the findings of the Commission in this case.
2. That the Planning Commission does hereby approve Variance 07-80
for nine (9) parking spaces, subject to the conditions attached
hereto.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 30th day of September, 1980, by the following vote,
to wit:

CONDITIONS OF APPROVAL
1. All requirements of any law, ordinance, or regulation of the State, City
and any other applicable government entity shall be complied with as
part of this Variance.
2. The Variance shall only apply to the use of the subject property by
Protection Services Inc. as described in Exhibit "A". This Variance
is subject to revocation by the Planning Commission if a change in
intensity of business activity results in increased parking demand.
