HomeMy WebLinkAboutRes No 652PLANNING COMMISSION RESOLUTION NO. 652 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING AN AMENDMENT OF AN APPROVED DEVELOPMENT PLAN TO ALLOW A CONFERENCE FACILITY AND ADDITIONAL HOTEL UNITS ON 2.54 ACRES OF A 29.29 ACRE SITE ON THE WEST SIDE OF HIGHWAY 111, SOUTH OF 44TH AVENUE. CASE NO. DP 03-80 (AMENDMENT) WHEREAS, pursuant to the provisions of the Palm Desert Zoning Ordinance, the Planning Commission of the City of Palm Desert, California, did on November 5, 1980, hold a duly noticed Public Hearing to consider an application from STEIN-BRIEF/VISTA for an Amendment of approved Development Plan to allow the construction of a 6,151 sq. ft. conference facility and 48 additional hotel units on 2.54 acres of a 29.29 acre site on the east side of Highway 111, south of 44th Avenue, more particularly described as: Tracts 4489-1 and 4489-2 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Services has deter- mined that the project has been previously assessed in connection with the Redevelopment Plan and related Environmental Impact Report. WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts to justify their actions, as described below: a. The proposed project, as amended, generally conforms to the purpose and intent of the PC(4) Zone District, Redevelopment Plan and City General Plan. b. The proposed project, as amended, and with specific exceptions to development standards granted, is adequately suited for the subject site and is compatible with existing and proposed development in the area. c. The proposed project, as amended, will not be detrimental to the health, safety and general welfare of the community. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. That the Planning Commission does hereby approve Case No. DP 03-80 (Amendment), subject to the conditions attached hereto. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 5th day of November, 1980, by the following vote, to wit: AYES: BERKEY, KRYDER, MCLACHLAN, RICHARDS, MILLER NOES: NONE ABSENT: NONE ABSTAIN: NONE ht KU j�. All conditions of Planning Commission Resolution Nos. 612, 639 and 643 shall be met, except as amended or added to below. 2. All requirements of the City Fire Marshal shall be met as part of development of this amended project per letters dated October 15, 1980, and March 18, 1980 (Standard Condition No. 8, Resolution No. 612). Special Condition No. 1, Resolution No. 612 is hereby amended to allow 6,151 sq.ft. conference facility and 48 hotel units yielding maximum of 96 rentable rooms on 2.54 acre site indicated as future phase. 4. Construction as proposed and approved by this amendment shall be done as a part of Phase I as designated by Resolution No. 643. 5. Hereby authorized as a part of this Amended Development Plan approval are the exceptions as listed in the following: a. Minimum setback from Painters Path, twenty (20) feet. b. Install a water system capable of delivering 4000 GPM fire flow for a four (4) hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 150 feet from a fire hydrant measured along approved vehicular travel ways. A. Hydrants shall not be located closer than 25 feet to any building. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. C. Curbs (if installed), shall be painted red 15 feet in either direction from each hydrant. 3. Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. Upon approval, one copy will be sent to the Building Department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer, and approved by the water company, with the following certification: "I certify that the design of the water system in Case Number DP 03-80 (amendment) is in accordance with the requirements prescribed by the Fire Marshal." Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. A 20 foot minimum access road shall be provided to all buildings. 7. All buildings and underground garage shall be protected with automatic fire sprinklers. 8. Hotel and underground garage shall be provided with wet and dry standpipe system. 9. Hotel shall be protected with a fire alarm system. 10. Fire lanes shall be provided. Very truly yours, David L.
