HomeMy WebLinkAboutRes No 663PLANNING COMMISSION RESOLUTION NO. 663 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING A VARIANCE FROM OFF-STREET PARKING REQUIREMENTS FOR A COMMERCIAL COMPLEX LOCATED ON THE SOUTH SIDE OF EL PASEO BETWEEN LUPINE LANE AND SAN PABLO AVENUE. CASE NO. VAR 10-80 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 2nd. day of December, 1980, hold a duly noticed Public Hearing to consider a request by PATRICIA DE MARBIEX for approval of a variance from off- street parking standards (15 spaces required, 3 spaces allocated), to permit a 5 station beauty salon to locate in a commercial complex within the C-1 (General Commercial) zone located on the south side of El Paseo between Lupine Lane and San Pablo Avenue, more particularly described as: APN 627-252-004 and 617-252-005 WHEREAS, said applicant has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Services has determined that the proposed project will not have a significant adverse impact on the environment and that a Negative Declaration has been prepared; Said Negative Declaration is hereby approved by the Commission; and, WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts to justify their actions, as described below: a. The strict enforcement of the commercial parking requirements would result in practical difficulty inconsistent with the objectives of the Zoning Ordinance; b. There are exceptional circumstances or conditions applicable to this property that do not apply generally to other properties in the C-1, S.P. General Commercial, Scenic Preservation Overlay, zone; c. The strict enforcement of the commercial parking requirements would deprive the applicant of privileges enjoyed by the owners of other property in the C-1 zone. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. That the Planning Commission does hereby approve Variance 10-80 for twelve parking spaces, subject to the conditions attached hereto. PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 2nd day of December, 1980, by the following vote, to wit: AYES: KRYDER, MCLACHLAN, RICHARDS, MILLER NOES: BERKEY ABSENT: NONE ABSTAIN: NONE L %/ �7 CHARL ES MILLER, Chairman ATTEST: RAMON A. All requirements of any law, ordinance, or regulation of the State, City and any other applicable government entity shall be complied with as a part of the variance.
