HomeMy WebLinkAboutRes No 673PLANNING COMMISSION RESOLUTION NO. 673 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, APPROVING A ONE YEAR TIME EXTENSION OF AN APPROVED CONDITIONAL USE PERMIT TO ALLOW CONSTRUCTION OF A 36 UNIT PLANNED RESIDENTIAL DEVELOP- MENT LOCATED EAST OF CHIA DRIVE, BETWEEN SKYWARD AND HOMESTEAD. CASE NO. CUP 05-79 (TIME EXTENSION) WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 14th day of January, 1981, hold a duly noticed Public Hearing to consider the request by WESTSIDE ENTERPRISES, LTD., for a one year Time Extension of an approved Conditional Use Permit to allow construction of a 36 unit planned residential development on 11 gross acres within the R-2 8,000 (Single Family Residential, 8,000 sq.ft. minimum lot) zone, located east of Chia Drive, between Skyward Way and Homestead Road, more particularly described as: APN 630-190-012 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Services has determined that the project has previously been assessed in connection with Case No. CUP 05-79 (original application) and no further documentation is deemed necessary; and, WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts to justify their actions, as described below: 1. The proposed location of the Conditional Use and the conditions under which it will be operated and maintained will not be detrimental to the public health, safety, or general welfare, or be materially injurious to the properties or improvements in the vicinity. 2. The proposed location of the Conditional Use is in accord with the objectives of the Zoning Ordinance and the purpose of the district in which the site is located. 3. The proposed Conditional Use complies with the goals, objectives, and policies of the City's adopted General Plan. 4. The considerations relating to the original approval are still valid. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. That the Planning Commission does hereby approve a one year time extension of Conditional Use Permit No. CUP 05-79, subject to those conditions contained in Planning Commission Resolution No. 528. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 14th day of January, 1981, by the PLANNING COMMISSION RESOLUTION NO. 673 January 14, 1981 following vote to wit: AYES: NOES: ABSENT: ABSTAIN: ATTEST: KRYDER, MCLACHLAN, MILLER NONE BERKEY, RICHARDS NONE RN N A.
