A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM
DESERT, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO
ALLOW THE DEVELOPMENT OF A 646 UNIT MOBILE HOME SUBDIVISION
GENERALLY LOCATED AT THE SOUTHEAST CORNER OF PORTOLA AVENUE
(EXTENDED) AND FRANK SINATRA DRIVE (EXTENDED).
CASE NO. CUP 17-80
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 14th day of January, 1981, hold a duly noticed Public Hearing to consider
a request by J. CAMERON ALLARD for approval of a Conditional Use Permit to allow the
development of a 646 unit mobile home subdivision on 141.5 net acres in the R-1 12,000
zone (Riverside County) (Change of Zone to R-M (UA) pending) generally located at the
southeast corner of Portola Avenue (extended) and Frank Sinatra Drive (extended), more
particularly described as:
APN 620-190-001 and 620-190-002
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the Director of Environmental Services has determined
that the project will not have a significant adverse impact on the environment and a
Negative Declaration, and a draft Environmental Impact Report for the North Sphere
of Influence has been prepared. Said Negative Declaration is hereby approved by the
Commission.
WHEREAS, at said Public Hearing, upon hearing and considering all testimony
and arguments, if any, of all interested persons desiring to be heard, said Planning
Commission did find the following facts to justify their actions, as described below:
1. The proposed project generally conforms to the intent
and purpose of the R-M Zone District.
2. The proposed project is adequately suited for the specific
site and is compatible with existing and proposed develop-
ment in the area.
3. The proposed project will not be detrimental to the health,
safety, and general welfare of the community.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the recitations are true and correct and
constitute the findings of the Commission in this case.
2. That the Planning Commission does hereby approve
conceptual Conditional Use Permit No. 17-80
(Exhibit A) subject to those conditions attached
thereto.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 14th day of January, 1981, by the following vote,
to wit:

CONDITIONS OF APPROVAL
CASE NO. CUP 17-80
Standard Conditions:
1. The development of the property shall conform substantially with Exhibits
(Case No. CUP 17-80) on file with the Department of Environmental Services,
as modified by the following conditions.
2. Prior to the issuance of a building permit for construction of any uses contem-
plated by this approval, the applicant shall first complete all the procedural
requirements of the City which include, but not limited to, Design Review,
Subdivision process, and building permit procedures.
3. Construction of the total development may be done in phases; however, each
individual phase shall meet or exceed all Municipal Code requirements to the
degree that the City could consider each phase as a single project.
4. Effective date of this approval shall be from time property is annexed to City.
5. Prior to the issuance of any City permits for the commencement of construction
on said project, the applicant shall agree in writing to these conditions of
approval
6. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all
Municipal Ordinances and State and Federal statutes now in force, or which
hereafter may be in force.
7. All existing electrical distribution lines, telephone, cable antenna television,
and similar service wires or cables, which are adjacent to the property being
developed shall be installed underground as a part of development from the nearest
existing pole not on the property being developed.
8. All requirements of the City Fire Marshal shall be met as part of the development
of this project Per attached letter dated December 11, 1980.
9. Construction plans shall be submitted for approval to the City Fire Marshal prior
to issuance of building permits. All conditions shall be made a part of construc-
tion and no certificate of occupancy shall be issued until completed.
10. Traffic control provisions shall be provided as required by the Director of
Public Works.
11. Curb, gutter, sidewalk or approved pathways, and tie-in paving shall be provided
in conformance with City standards and/or as required by the Director of Public
Works
12. Prior to issuance of a building permit for construction of any use contemplated
by this approval, the applicant shall first obtain permits and/or clearance
from the following agencies:
Riverside County Department of Health
Palm Desert Design Review Board Process
City Fire Marshal
Coachella Valley County Water District
Evidence of said permit or clearance from the above agencies shall be presented
to the Department of Building and Safety at the time of issuance of a building
permit for the use contemplated herewith.
13. No development shall occur on the subject property prior to recordation of a
tract map.
14. Construction of a portion of said project shall commence within one year of
effective date of approval; otherwise said approval shall become null, void,
and of no effect whatsoever.

SPECIAL CONDITIONS
1. Loop street running parallel to east property line shall be curved towards
east property line to eliminate straight run of street.
2. Sink tennis courts 3 feet from adjacent grade.
3. Solar heating to be used for pools with panels designed to compliment
architecture.
4. Breakdown of clubhouse square footage to be submitted to Design Review Board
to verify that 100 parking spaces complies with parking requirements.
5. Street entries on Portola Avenue and 39th Avenue to be designed to provide
on site stacking for four (4) vehicles per lane and turnaround for rejected
vehicles.
6. Outbound Portola Avenue to be provided with two lanes.
7. R.V. storage entry on Frank Sinatra Drive to provide minimum 40 foot on -site
stacking area; and, be aligned with entry proposed for north side of Frank
Sinatra Drive (C/Z 04-80 and CUP 18-80).
8. Tentative Tract Map to be filed and approved concurrently with
Design Review Case.
9. Dedication and full improvement of Frank Sinatra Drive, Portola Avenue and 39th
Avenue to City standards including curb and gutter, sidewalk and asphalt paving.
10. Drainage and signalization fund fees as required by City ordinance shall be
paid prior to recordation of the final map.
11. Drainage facilities shall be provided per Ordinance No. 218 and the Master
Drainage Plan to the specifications of the Public Works Director.
12. Full public improvements including traffic safety lighting as required by
ordinance and the Public Works Director shall be installed in accordance
with City standards.
13. Improvement plans for water and sewer systems shall be approved by the res-
pective service districts.
14. Complete improvement plans and specifications shall be submitted as required
by ordinance to the City Engineer for checking and approval before construction
of any improvements is commenced. The subdivider shall submit "as -built" plans
prior to acceptance of the subdivision improvements by the City.
15. All private streets shall be inspected by the Engineering Department and a
standard inspection fee shall be paid.
16. Additional storm drain construction shall be contingent upon a drainage study
by the private engineer.

Prior to construction of any of the proposed buildings, the following conditions
must be met:
1. Install a water system capable of delivering 2500 GPM fire flow for a two (2)
hour duration in addition to domestic or other supply. The computation shall
be hased upon a minimum of 20 psi residual operating pressure in the supply
main from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants so that no point of any building
is more than 250 feet from a fire hydrant measured along approved vehicular
travel ways.
A. Hydrants shall not be located closer than 25 feet to any buildings.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome
yellow, and the tops and nozzle caps shall be painted green.
C. Curbs (if installed), shall be painted red 15 feet in either
direction from each hydrant.
3. Prior to issuance of a building permit, the developer shall furnish
the original and three (3) copies of the water system plan to the
Fire Marshal for review. Upon approval, one copy will be sent to
the Building Department, and the original will be returned to the
developer
4. The water system plan shall be signed by a registered civil engin-
eer, and approved by the water company, with the following certifi-
cation: "I certify that the design of the water system in Case
Number Cup 17-80 is in accordance with the requirements prescribed
by the Fire Marshal."

5. Prior to delivery of combustible materials to the building site,
the required water system shall be installed, operating and
delivering the required flow.
6. Access gates shall be electronically controlled by emergency
vehicles.
