HomeMy WebLinkAboutRes No 688PLANNING COMMISSION RESOLUTION NO. 688 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING APPROVAL TO THE CITY COUNCIL OF A TENTATIVE TRACT MAP TO ALLOW AN APARTMENT CONVERSION TO CONDOMINIUMS ON THE SOUTH SIDE OF SHADOW MOUNTAIN DRIVE, 50 FEET WEST OF LUPINE LANE. CASE NO. TT 17487 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 3rd day of March, 1981, hold a duly noticed Public Hearing to consider the request of DON TRIVETT for approval of a Tentative Tract Map to allow the con- version of six existing apartments to airspace condominiums within the R-3 13,000 (3) (Multifamily Residential, 13,000 sq.ft. minimum lot size, one unit per 3,000 sq.ft. of lot area) zone located on the south side of Shadow Mountain Drive 50 feet west of Lupine Lane, more particularly described as: Lots 5 & 6, Block P, Palm Desert Unit #1 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Services has determined that the project is categorically exempt from the guidelines for implementation of the California Environmental Quality Act, as amended, per Section 15101, Class I, and no further documentation is deemed necessary. WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to recommend approval of the Tentative Tract Map: 1. The subject Tentative Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended. 2. The subject Tentative Map does comply with the adopted General Plan and the Palm Desert Zoning Ordinance. 3. The site is physically suitable for the type of development proposed. 4. The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or serious health problems. WHEREAS, in the review of this Tentative Tract Map the Planning Commission has considered the effect of the contemplated action on the housing needs of the region for purposes of balancing these needs against the public service needs of the residents of the City of Palm Desert and its environs, with available fiscal and environmental resources. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That it does hereby recommend conditional approval to the City Council of the City of Palm Desert of the above described Tentative Map No. 17487 for the reasons set forth in this Resolution and subject to the attached conditions. PASSED, APPROVED and ADOPTED at a regular meeting of Palm Desert Planning Commission, held on this 3rd day of March, 1981, by the following vote, to wit: AYES: BERKEY, KRYDER, MCLACHLAN, MILLER, RICHARDS NOES: NONE ABSENT: NONE ABSTAIN: NONE CHARL'ES MILLER, Chairman ATT E,.S,T : /\ MON A. Drainage and signalization fees as required by City Ordinance shall be paid prior to recordation of final map. 2. Sidewalks per City standards be installed prior to recordation of final map.
