HomeMy WebLinkAboutRes No 690PLANNING COMMISSION RESOLUTION N0. 690 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING AN AMENDMENT TO A PREVIOUSLY APPROVED DEVELOPMENT PLAN TO ALLOW 16,380 SQ.FT. OF RES- TAURANT USES IN A PORTION OF A COMMERCIAL COMPLEX ON APPROX- IMATELY 7.23 ACRES, WITHIN THE P.C. (3), S.P. (PLANNED COMMERCIAL, SCENIC PRESERVATION OVERLAY) ZONE, GENERALLY LOCATED AT THE SOUTHEAST CORNER OF EL PASEO AND HIGHWAY 111. CASE NO. DP 06-80 (AMENDMENT) WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 3rd day of March, 1981, hold a duly noticed Public Hearing to consider a request by GERALD J. CHAZAN for an Amendment to an approved Development Plan to allow two (2) restaurants (total floor area 16,380 sq.ft.) in a 71,280 sq.ft. commercial center within the PC (3), S.P. (Planned Regional Commercial, Scenic Preservation Overlay) zone generally located at the southeast corner of the intersection of El Paseo and Highway 111, more particularly described as: Parcel 2 of PM 14647 WHEREAS, said applicant has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Services has determined that the project has previously been assessed in connection with Case No. DP 15-78 (original request), and no further documentation is deemed necessary; WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts to justify their actions, as described below: a. The proposed project amendment generally conforms to the intent and purpose of the PC zone district. b. The proposed project amendment is adequately suited for the specific site and is compatible with existing and proposed development in the area. c. The proposed project amendment will not be detrimental to the health, safety and general welfare of the community. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That the Planning Commission does hereby approve an amendment to the list of uses permitted in the development of Case No. DP 06-80 to include two restaurants containing 16,380 sq.ft., subject to compliance with all of the conditions originally imposed in Planning Commission Resolution No. 613 and those set forth herein. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 3rd day of March, 1981, by the following vote, to wit: AYES: BERKEY, KRYDER, MILLER, RICHARDS, MCLACHLAN NOES: NONE ABSENT: NONE ABSTAIN: NONE CHARLES MILLER, Chairman ATTEST: -7 ON A. DIAZ, Secr PLANNING COMMISSION RESOLUTION NO. 690 Page Two Special Condition 1. Applicant shall make every effort to provide the seven (7) parking spaces deleted as a result of the proposed amendment.
