HomeMy WebLinkAboutRes No 694PLANNING COMMISSION RESOLUTION NO. 694 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A ONE YEAR TIME EXTENSION OF A DEVELOPMENT PLAN TO ALLOW CONSTRUCTION OF 156 RESIDENTIAL UNITS, RECREATIONAL AMENITIES AND OPEN SPACE AND RELATED DESIGN REVIEW APPLICATION ON APPROXIMATELY 34.06 GROSS ACRES AT THE NORTHEAST CORNER OF HOVLEY LANE (EXTENDED) AND COOK STREET. CASE NOS. DP 04-80 AND 204 MF WHEREAS, the Planning Commission of the City of Palm Desert, California, did hold a duly noticed Public Hearing on March 31, 1981, to consider a request by J.M. PETERS COMPANY for approval of a one year time extension to allow construction of 156 residential units, related recreational amenities and open space and related design review application, on approximately 34.06 gross acres within the PR-5, S.P. (Planned Residential, max. 5 d.u./acre, Scenic Preservation Overlay) zone at the northeast corner of Hovley Lane (extended) and Cook Street, more particularly described as: Parcel. No. 1 of Parcel Map 13406 WHEREAS, said application has complied with the requirements of the "City of of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Services has determined that the project will not have a significant adverse impact on the environment and a Negative Declaration has been prepared. WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, the Planning Commission did find the following facts and reasons to exist to justify the approval of the subject Development Plan and Preliminary Design Review: 1. The proposed development is consistent with the City's adopted General Plan. 2. The proposed use is similar to and compatible with those contemplated on nearby properties. 3. The design or improvements of the proposed development will be consistent with the Palm Desert Zoning Ordinance. 4. The site is physically suited for both the type of develop- ment proposed and the proposed density. 5. The design of the development and the proposed improvements are not likely to cause substantial environmental damage or have a serious effect on the public health, safety, or general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and consti- tute the findings of the Planning Commission in this case. 2. The Planning Commission does hereby approve a one year time extension for DP 04-80 and 204 MF for reasons stated, subject to conditions contained in Planning Commission Resolution No. 587. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 31st day of March, 1981, by the following vote, to wit: AYES: BERKEY, KRYDER, RICHARDS, MILLER NOES: NONE ABSENT: MCLACHLAN ABSTAIN: NONE ATT G' MI LER, Chai rman irman DIAZ, Secr tary /1r
