HomeMy WebLinkAboutRes No 696PLANNING COMMISSION RESOLUTION NO. 696 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING A CONDITIONAL USE PERMIT TO ALLOW OPERATION OF AN ELECTRONIC GAMES ARCADE WITHIN A COMMERCIAL BUILDING LOCATED AT 73-180 HIGHWAY 111. CASE NO. CUP 02-81 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 31st day of March, 1981, hold a duly noticed Public Hearing and continued Public Hearing on April 15, 1981, to consider approval of a request by ROBIN SHOU for a Conditional Use Permit to allow the operation of an electronic games arcade in a 1,000 sq.ft. building within the C-1, S.P. (General Commercial, Scenic Preservation Overlay) zone located at 73-180 Highway 111, more particularly described as: APN 627-071-041 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Services has determined that the project is categorically exempt from the guidelines for implementation of the California Environmental Quality Act, as amended, per Section 15103, Class 3, and no further documentation is deemed necessary. WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Commission did find the following facts and reasons to exist to justify the approval of said Conditional Use Permit: 1. The proposed location of the Conditional Use is in accord with the objectives of the Zoning Ordinance and the purpose of the district in which the site is located. 2. Sufficient parking exists on -site and on the adjacent frontage road to serve the proposed use. 3. Property owners within 300 feet have not objected to the proposed use. 4. The granting of the Conditional Use Permit would allow the economic use of a new building which has remained vacant for nine months. 5. The proposed location of the conditional use and the conditions under which it will be operated and maintained will not be detrimental to the public health, safety, or general welfare, or be materially injurious to properties or improvements in the vicinity. 6. The proposed conditional use complies with the goals, objectives, and policies of the City's adopted General Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. That approval of Conditional Use Permit CUP 02-81 is hereby granted to ROBIN SHOU for reasons subject to the attached conditions. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert PLANNING COMMISSION RESOLUTION NO. 696 Page Two Planning Commission held on this 15th day of April, 1981, by the following vote, to wit: AYES: BERKEY, KRYDER, MCLACHLAN, RICHARDS, MILLER NOES: NONE ABSENT: NONE ABSTAIN: NONE CHLES FILLER, Chairman ATTEST: /1r PLANNING COMMISSION RESOLUTION NO. 696 Page Three CONDITIONS OF APPROVAL Case No. CUP 02-81 1. Hours of operation are limited to between 9:00 a.m. and 10:00 p.m. 2. This approval shall be valid for a nine (9) month period commencing from the issuance of a business license. At the end of this trial period, the permit will be reviewed at a duly noticed public hearing before the Planning Commission and if conditions warrant, extended, modified or revoked. 3. If at any time, significant problems develop arising from the operation of the proposed use, a duly noticed public hearing will be scheduled before the Planning Commission to consider revocation of this Conditional Use Permit. 4. That there be one employee on the premises during the hours of operation.
