HomeMy WebLinkAboutRes No 697PLANNING COMMISSION RESOLUTION NO. 697 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL APPROVAL OF A CHANGE OF ZONE FROM 'P', PC (2), AND PC (2) S.P. TO PR-4 AND PR-4 S.P. FOR PROPERTY LOCATED AT THE SOUTHWEST AND SOUTH- EAST CORNERS OF COUNTRY CLUB DRIVE AND COOK STREET. CASE NO. C/Z 02-81 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 31st day of March, 1981, hold a duly noticed public hearing and continued hearing on April 15, 1981, to consider a request by SUNRISE COMPANY for a change of zone from 'P' (Public/Institutional District), PC (2) (District Commercial Center) and PC (2) (District Commercial Center, Scenic Preservation Overlay) to PR-4 (Planned Residential District, maximum 4 d.u./acre) and PR-4 S.P. (Planned Residential Dis- trict, Scenic Preservation Overlay) for property located at the southwest and south- east corners of Country Club Drive and Cook Street, more particularly described as: A Portion of the Northeast Quarter, Section 9, and the Northwest Quarter, Section 10, T5S, R6E WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Services has deter- mined that the project will not have an adverse impact on the environment and a Negative Impact has been prepared. WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts to justify their actions, as described below: 1. The land use resulting from the change of zone would be compatible with adjacent proposed land uses. 2. The density resulting from the change of zone would be compatible with densities permitted in the adjacent areas. 3. The proposed change of zone would be compatible with the adopted and proposed revised Palm Desert General Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in these cases; 2. That the Planning Commission does hereby recommend to the City Council approval of a change of zone from 'P' and PC (2) and PC (2) S.P. to PR-4 S.P. and from PC (2) to PR-4 as shown on the attached Exhibit "A". 3. That a Negative Declaration of Environmental Impact is hereby recommended for certification. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 15th day of April, 1981, by the following vote, to wit: AYES: BERKEY, KRYDER, MCLACHLAN, RICHARDS, MILLER NOES: NONE ABSENT: NONE ABSTAIN: NONE CHARL S MI LER, Chairman ATTEST: )k.
