HomeMy WebLinkAboutRes No 698PLANNING COMMISSION RESOLUTION NO. 698 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING APPROVAL TO THE CITY COUNCIL OF A TENTATIVE TRACT MAP TO ALLOW 975 SINGLE FAMILY CONDOMINIUM UNITS ON THE SOUTH SIDE OF COUNTRY CLUB DRIVE, EAST OF COOK STREET. CASE NO. TT 15633 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 31st day of March, 1981, hold a duly noticed public hearing and continued hearing on April 15, 1981, to consider the request of SUNRISE COMPANY for approval of a Tentative Tract Map for 224 lots to allow construction of 975 single family condo- minium units in the PR-4, S.P. (Planned Residential District, maximum 4 d.u./acre, Scenic Preservation Overlay) zone on property located at the southeast corner of Country Club Drive and Cook Street, more particularly described as: North z of Section 10, T5S, R6E, SBM WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Services has determined that the project will not have a significant adverse impact on the environment and a Negative Declaration has been prepared. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Planning Commission did find the following facts and reasons justified in the staff report for TT 15633 dated April 15, 1981, to exist to recommend approval of the Tentative Tract Map: (a) That the proposed map is consistent with applicable general and specific plans. (b) That the design or improvement of the proposed subdivision is consistent with applicable general and specific plans. (c) That the site is physically suitable for the type of development. (d) That the site is physically suitable for the proposed density of development. (e) That the design of the subdivision or the proposed improvements are not likely to cause substantial envir- onmental damage or substantially and avoidably injure fish or wildlife or their habitat. (f) That the design of the subdivision or the type of improvements is not likely to cause serious public health problems. (g) That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision. WHEREAS, in the review of this Tentative Tract Map the Planning Commission has considered the effect of the contemplated action on the housing needs of the region for purposes of balancing these needs against the public service needs of the residents of the City of Palm Desert and its environs, with available fiscal and environmental resources. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That it does hereby recommend conditional approval to the City Council of the City of Palm Desert of the above described Tentative Map No. 15633 for the reasons set forth in this Reso- lution and subject to the attached conditions. PLANNING COMMISSION RESOLUTION NO. 698 Page Two FURTHER, BE IT RESOLVED that the recommended conditions of approval do include a requirement that the applicant pay a fee to comply with the requirements of Article 26.48 of the City of Palm Desert Subdivision Ordinance. In return it is recommended that the City Council agree to use said fees for park purposes in conformance with an adopted master plan, within five (5) years of the recordation of the final map. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. 2. Full public improvements including traffic safety lighting as required by Ordinance and the City Engineer shall be installed in accordance with City standards. 3. Prior to submittal of the Final Map, the applicant shall provide the Depart- ment of Environmental Services with a list of proposed street names with at least three alternatives. The approval of the final street name shall be made by the Director of Environmental Services. 4. Access rights to Country Club Drive, Cook Street and new street along eastern boundary shall be offered to the City as a dedication on the Final Map. 5. The CC&R's for this development shall be submitted to the Director of Envir- onmental Services for review and final approval by the City Attorney prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the applicant shall submit to the City Engineer: a. The document to convey title. b. Covenants and restrictions to be recorded. c. Management and maintenance agreement to be entered into with the owners of the units of the project. 6. Improvement plans for water and sewer systems shall meet the requirements of the respective service districts. 7. Area shall be annexed to appropriate Improvement Districts having jurisdiction over the subject area. 8. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. 9. All on -site utilities, including cable TV, shall be placed underground and shall be completely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services. 10. Complete plans and specifications shall be submitted as required by Ordinance to the City Engineer for checking and approval before construction of any improvements is commenced. The subdivider shall submit "as built" plans prior to acceptance of the subdivision improvements by the City. 11. In order to maintain reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings. An adequate number of fire hydrants with required fire flows shall be installed as recommended by the Fire Marshal. 12. Prior to recordation of the Final Map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 13. All requirements of the City Fire Marshal from his letter of March 17, 1981, shall be met as a part of the development of this tract. 14. The water system shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system of Tract No. 15633 is in accordance with the requirements prescribed by the City Fire Marshal." 15. All private streets shall be inspected by the Engineering Department and a Standard Inspection Fee shall be paid. PLANNING COMMISSION RESOLUTION NO. 698 Page Four 16. All requirements of the Planning Commission action on the Development Plan 02-81 shall be met as a part of the development of this tract. 17. The applicant shall have twelve (12) months from the date of the approval or conditional approval of the tentative map for filing of the final map unless an extension of time of up to eighteen (18) months is granted by a Resolution of the City Council. 18 Drainage and Signalization Fund contributions as required by City Ordinance shall be made prior to recordation of the Final Map. 19. Development shall pay a fee in lieu thereof as a condition of the Final Map, for park and recreation purposes. The City shall commit the use of any such fees received within a five year period. 20. Dedication on Country Club Drive and Cook Street to provide for right-of-way to 55 feet from centerline. 21. Full improvement of Cook Street and Country Club Drive to City of Palm Desert standards and specifications. 22. Cul-de-sacs shall have a minimum 40 foot radius. 23. Del Safari Road (El Dorado Drive) shall be dedicated and improved to half - street standards per City of Palm Desert standards and County of Riverside standards, unless modified or deleted by staff, subject to review by Planning Commission. 24. Minimum street grades shall be 0.4 percent. 25. Vehicular underpass and golf cart underpass on Cook Street shall be constructed to coordinate with development to the east of Cook Street. 26. Vehicular access shall be provided to Del Safari Road (El Dorado Drive) when and if the street is installed. 27. Landscaping maintenance on Cook Street and Country Club Drive shall be provided by the homeowners association of the development. 28. Existing electrical utilities on Country Club Drive shall be undergrounded. 29. Traffic safety striping on Cook Street and Country Club Drive shall be provided by the developer upon completion of the street widening. 30. Drainage facilities shall be provided per Ordinance No. 218 and the Master Drainage Plan to the specifications of the Public Works Director. 31. Additional storm drain construction shall be contingent upon a drainage study by the private engineer. 32. Final Map not to be recorded until design changes, if required by approval of preliminary plans by the Design Review Board are incorporated. 33. Blowsand planting to be provided along northern and western boundaries of subdivision as approved by Design Review Board. 34. Subdivision to be provided with minimum six foot high solid masonry wall around project (except for approved openings) as approved by Design Review Board. BOX 248 210 WEST SAN JACINTO STREET PERRIS, CALIFORNIA 92370 TELEPHONE (714) 657-3183 Provide the following fire protection in accordance with the Uniform Fire Code: 1. Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a two hour duration in addition to domestic supply. The computa- tion shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants located at each street intersection (a) but not greater than 500 feet apart in any direction. A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. B. Curbs shall be painted red 15 feet in either direction from each hydrant. 3. Prior to recordation of the final map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the de- sign of the water system in Tract No. 15633, 15640, DP 02-81 is in accordance with the requirements prescribed by the Fire Marshal." Upon approval, the original plan will be returned to the developer. 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Cul-de-sac streets are limited to 750 feet in length, unless modified by City Fire Marshal. 7. Tennis Club and Main Clubhouse shall be fully protected with automatic fire sprinkler systems. This project is outside ne 5 minute fire departments response area and must participate in the funding for a Fire Station Site, Fire Station Facility, Fire Apparatus and Equipment necessary for adequate fire protection.
