HomeMy WebLinkAboutRes No 710PLANNING COMMISSION RESOLUTION NO. 710 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A ONE YEAR TIME EXTENSION OF AN APPROVED DEVELOPMENT PLAN TO ALLOW THE CONSTRUCTION OF 24 CONDOMINIUMM1 UNITS ON 5 ACRES LOCATED ON THE SOUTH SIDE OF HOVLEY LANE, APPROXIMATELY 1,700 FEET EAST OF MONTEREY AVENUE. CASE NO. DP 02-80 WHEREAS, the Planning Commission of the City of Palm Desert, California, did hold a duly noticed Public Hearing on the 5th day of May, 1981, to consider a request by DAVID MOSS, T&D INVESTMENTS, for a 12 month Time Extension of an approved Residential Development Plan to allow the construction of 24 condominium units on 5 acres within the PR-5 (Planned Residential maximum density 5 d.u./ac.) zone, located on the south side of Hovley Lane approximately 1,700 feet east of Monterey Avenue, more particularly described as: APN 621-190-073 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Services has determined that the project has previously been assessed in connection with Case No. DP 18-78 and no further documentation is deemed necessary; WHEREAS, at said Public Hearing, upon hearing and considering all testi- mony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts to justify their actions, as described below: a. The proposed project generally conforms to the intent and purpose of the PR Zone District. b. The proposed project is adequately suited for the specific site and is compatible with existing and proposed development in the area. c. The proposed project will not be detrimental to the health, safety and general welfare of the community. d. The considerations relating to the original approval are still valid. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. That the Planning Commission does hereby approve a one year time extension of conceptual Development Plan No. DP 02-80, subject to those conditions contained in Planning Commission Resolution No. 578. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 5th day of May, 1981, by the following vote, to wit: AYES: BERKEY, KRYDER, MCLACHLAN, MILLER, RICHARDS NOES: NONE ABSENT: NONE ABSTAIN: NONE CHARL`ES MILLER, Chairman ATTEST: MON A.
