HomeMy WebLinkAboutRes No 713PLANNING COMMISSION RESOLUTION NO. 713 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL APPROVAL OF A CHANGE OF ZONE FROM W-2-20 (RIVERSIDE COUNTY) TO PC(2) (81.3 ACRES) AND PR-5 (671.9 ACRES) GENERALLY LOCATED SOUTH OF INTERSTATE 10, BETWEEN DEL SAFARI ROAD AND PORTOLA AVENUE (EXTENDED), NORTH OF FRANK SINATRA DRIVE. CASE NO. C/Z 03-81 (U.A.) WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 20th day of May, 1981, hold a duly noticed Public Hearing to consider a request by LIONEL STEINBERG for a Change of Zone upon annexation from W-2-20 (controlled Development Area, 20 acre minimum lot area)(Riverside County) to PC(2)(Planned District Commercial) zone (81.3 acres) and PR-5 (Planned Residential 5 d.u./ac. maximum density) zone (671.9 acres) generally located south of Inter- state 10, between Del Safari Road and Portola Avenue (extended) north of Frank Sinatra Drive, more particularly described as: APNS 653-006, 653-390-001, thru 012, 653-420-003, 653-280-002, 653-280-004, 653-410-002 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Services has determined that the project will not have a significant adverse impact on the environ- ment and a Negative Declaration has been prepared. WHEREAS, at said Public Hearing, upon hearing and considering all testi- mony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts to justify their actions, as described below: 1. The land use resulting from the Change of Zone would be compatible with adjacent proposed land uses. 2. The density resulting from the Change of Zone would be compatible with densities permitted in the adjacent areas. 3. The proposed Change of Zone would be compatible with the adopted and proposed revised Palm Desert General Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in these cases; 2. That the Planning Commission does hereby recommend to the City Council approval of a Change of Zone from W-2-20 (Riverside County) to PC(2) (U.A.) (81.3 acres) and PR-5 (U.A.) (671.9 acres) as shown on the attached map labeled Exhibit "A". 3. That a Negative Declaration of Environmental Impact is hereby recommended for certification. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 20th day of May, 1981, by the following vote, to wit: AYES: BERKEY, KRYDER, MCLACHLAN, MILLER, RICHARDS NOES: NONE ABSENT: NONE ABSTAIN: NONE CHARLE'S E.
