HomeMy WebLinkAboutRes No 715PLANNING COMMISSION RESOLUTION NO. 715 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A COMMERCIAL DEVELOPMENT PLAN TO ALLOW CONSTRUCTION OF A 396 UNIT HOTEL, RESTAURANT AND 14,700 SQUARE FEET OF COMMERCIAL OFFICES ON 20.5 ACRES LOCATED ON THE NORTH SIDE OF HIGHWAY 111, 650 FEET EAST OF DEEP CANYON ROAD AND CERTIFYING A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AS IT PERTAINS THERETO. CASE NO. DP 07-81 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 2nd day of June, 1981, hold a duly noticed Public Hearing to consider a request by BERNARD SOLOMON for approval of a Commercial Development Plan to allow construction ofa 396 unit hotel (204 hotel rooms and 192 "Casitas Units"), restaurant and 14,700 sq.ft. of Commercial offices on 20.5 acres within the PC (4), N. S.P. (Planned Resort Commercial, Natural Factors, Scenic Preservation Overlays) zone, and PR-5, N (Planned Residential, maximum 5 d.u./acre, Natural Factors) zone, located on the north side of Highway 111, 650 feet east of Deep Canyon, more particularly described as: APN 625-100-008, 009, 011, 017 thru 020 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Services had determined that the project will not have a significant adverse impact on the environment and a Negative Declaration has been prepared. WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts to justify their actions, as described below: a. The proposed project generally conforms to the intent and purpose of the PR Zone District, and PC-4 Zone District. b. The proposed project is adequately suited for the specific site and is compatible with existing and proposed develop- ment in the area. c. The proposed project will not be detrimental to the health, safety and general welfare of the community. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That the Planning Commission does hereby approve Con- ceptual Development Plan No. 07-81 subject to those conditions attached hereto. 3. That a Negative Declaration of Environmental Impact is hereby certified. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission held on this 2nd day of June, 1981, by the following vote, to wit: AYES: KRYDER, MCLACHLAN, RICHARDS, MILLER NOES: NONE ABSENT: BERKEY ABSTAIN: NONE CHARLES MIL ATTEST: ‘ON A. DIAZ, Sectary , Chairman PLANNING COMMISSION RESOLUTION NO. 715 Page Two CONDITIONS OF APPROVAL CASE NO. DP 07-81 1. The development of the property shall conform substantially with Exhibits (Case No. DP 07-81) on file with the Department of Environmental Services, as modified by the following conditions. 2. Prior to the issuance of a building permit for construction of any uses con- templated by this approval, the applicant shall first complete all the pro- cedural requirements of the City which include, but are not limited to, Design Review, Subdivision process, and building permit procedures. 3. Construction of the total development may be done in phases; however, each individual phase shall meet or exceed all Municipal Code requirements to the degree that the City could consider each phase as a single project. 4. Construction of a portion of said project shall commence within one year from the date of final approval otherwise said approval shall become null, void and of no effect whatsoever. 5. Effective date of approval to be date of final approval of TT 17103 by City Council. 6. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. 7. All existing electrical distribution lines, telephones, cable antenna television, and similar service wires or cables, which are adjacent to the property being developed shall be installed underground as a part of development from the near- est existing pole not on the property being developed. 8. All requirements of the City Fire Marshal shall be met as part of the develop- ment of this project per attached letter dated May 13, 1981. 9. Construction plans shall be submitted for approval to the City Fire Marshal prior to issuance of building permits. All conditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. 10. Traffic control provisions shall be provided as required by the Director of Public Works. 11. Curb, gutter, sidewalk or approved pathways, and tie-in paving shall be provided in conformance with City Standards and/or as required by the Director of Public Works. 12. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Design Review Board Process City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to the Department of Building and Safety at the time of issuance of a building permit for the use contemplated herewith. 13. No building permits shall be issued on the subject property prior to the recordation of a tract map. 14. Drainage and Signalization fund fees as required by City ordinance shall be paid prior to recordation of the final map. 15. Drainage facilities shall be provided per Ordinance No. 218 and the Master Drainage Plan to the specifications of the Public Works Director. The developer shall construct the Master Plan Storm Drains that traverse the property in an east -west and north -south direction. No structures shall be constructed within the storm drain easements. Full public improvements, including traffic safety lighting as required by ordinance and the Public Works Director, shall be installed in accordance with City standards. 17. Improvement plans for water and sewer systems shall be approved by the respective service districts. 18. Complete improvement plans and specifications shall be submitted as required by ordinance to the City Engineer for checking and approval before construction of any improvements is commenced. The subdivider shall submit "as -built" plans prior to acceptance of the subdivision improvements by the City. 19. All private streets shall be inspected by the engineering department and a standard inspection fee shall be paid. 20. Additional storm drain construction shall be contingent upon a drainage study by the private engineer. 21. Vehicular access to Highway 111 shall be as approved by Caltrans. 22. The developer shall dedicate sufficient right-of-way as required by Caltrans and post a bond for five years or until adjacent property develops, which- ever occurs first, for the widening of Highway 111 to three lanes. Improve- ment plans shall be submitted to the Public Works Department. 23. Developer shall make a cash payment of the City of Palm Desert for one-half the cost of the installation of medians in Highway 111. 24. Relocate commercial buildings from PR-5 zone. 25. Redesign northwest corner of hotel parking lot to provide for 2-way circulation. 26. Hotel parking area to be screened from Highway 111 by use of berming and landscaping. 27. Along the boundary with the condominium development to the north and west, install and maintain a minimum 7 foot solid hedge and or increase the height of the existing wall to seven feet. 28. Tennis courts shall be sunk 4 feet below the grade of adjacent land. 29. Street lighting of perimeter drive shall be directed away from residential uses on the north and west. Install a water system capable of delivering 3500 GPM fire flow for a three (3) hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. A. Hydrants shall not be located closer than 25 feet to any building. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. C. Curbs (if installed) shall be painted red 15 feet in either direction from each hydrant. 3 Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. Upon approval, one copy will be sent to the Building Department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer, and approved by the water company, with the following certification: 'II certify that the design of the water system in Case Number DP 07-81 is in accordance with the requirements prescribed by the Fire Marshal." 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow.
