A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM
DESERT, CALIFORNIA, RECOMMENDING APPROVAL TO THE CITY COUNCIL
A TENTATIVE LOT FOR PHASING PURPOSES OF A RESORT HOTEL DEVEL-
OPMENT LOCATED ON THE NORTH SIDE OF HIGHWAY 111 650 FEET EAST
OF DEEP CANYON ROAD AND A NEGATIVE DECLARATION OF ENVIRON-
MENTAL IMPACT AS IT PERTAINS THERETO.
CASE NO. TT 17108
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 2nd day of June, 1981, hold a duly noticed public hearing to consider a
request by BERNARD SOLOMON for approval of a 9 lot tentative tract map for phasing
purposes for a 396 unit Resort Hotel/Restaurant/Professional Office Development on
20.5 acres within the PC(4), N, S.P. (Planned Resort Commercial, Natural Factors,
Scenic Preservation Overlay) zone, and PR-5, N (Planned Residential, maximum 5 d.u./ac.
Natural Factors) zone, located on the north side of Highway 111, 650 feet east of
Deep Canyon, more particularly described as:
APN 625-100-008, 009, 011, 017 thru 020
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the Director of Environmental Services has determined
that the project will not have a significant adverse impact on the environment and
a Negative Declaration has been prepared.
WHEREAS, at said public hearing, upon hearing and considering all testimony
and arguments, if any, of all persons desiring to be heard, said Planning Commission
did find the following facts and reasons justified in the staff report for TT 17108
dated June 2, 1981, to exist to recommend approval of the Tentative Tract Map:
(a) That the proposed map is consistent with applicable general
and specific plans.
(b) That the design or improvement of the proposed subdivision
is consistent with applicable general and specific plans.
(c) That the site is physically suitable for the type of development.
(d) That the site is physically suitable for the proposed density of
development.
(e) That the design of the subdivision or the proposed improvements are
not likely to cause substantial environmental damage or substan-
tially and avoidably injure fish or wildlife or their habitat.
(f) That the design of the subdivision or the type of improvements is
not likely to cause serious public health problems.
(g) That the design of the subdivision or the type of improvements will
not conflict with easements, acquired by the public at large, for
access through or use of, property within the proposed subdivision.
WHEREAS, in the review of this Tentative Tract Map the Planning Commission
has considered the effect of the contemplated action on the housing needs of the
region for purposes of balancing these needs against the public service needs of the
residents of the City of Palm Desert and its environs, with available fiscal and
environmental resources.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, as follows:
1. That the above recitations are true and correct and constitute the
findings of the Commission in this case;
2. That it does hereby recommend conditional approval to the City
Council of the City of Palm Desert of the above described Tentative
Map No. 17108 for the reasons set forth in this Resolution and
subject to the attached conditions.

3. That a Negative Declaration of Environmental Impact is hereby
recommended for approval.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 2nd day of June, 1981, by the following vote,

CONDITIONS OF APPROVAL
CASE NO. TT 17108
1. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all
the requirements, limitations, and restrictions of all municipal ordinances
and State and Federal statutes now in force, or which hereafter may be in
force.
2. Full public improvements including traffic safety lighting as required by
ordinance and the City Engineer shall be installed in accordance with City
standards.
3. Improvement plans for water and sewer systems shall meet the requirements of
the respective service districts.
4. Area shall be annexed to appropriate improvement districts having jurisdiction
over the subject area.
5. All dedicated land and/or easements required by this approval shall be granted
to the City of Palm Desert, without cost to the City and free of all liens
and encumbrances.
6. All on -site utilities, including cable TV, shall be placed underground and
shall be completely concealed from view except certain appurtenances as may
be approved by the Director of Environmental Services.
7. Complete plans and specifications shall be submitted as required by Ordinance
to the City Engineer for checking and approval before construction of any
improvements is commenced. The subdivider shall submit "as -built" plans prior
to acceptance of the subdivision improvements by the City.
8. In order to maintain reasonable fire protection during the construction period,
the subdivider shall maintain passable vehicular access to all buildings. An
adequate number of fire hydrants with required fire flows shall be installed as
recommended by the Fire Marshal.
9. Prior to recordation of the final map, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
10. All requirements of the City Fire Marshal from his letter of May 13, 1981, shall
be met as a part of the development of this tract.
11. The water system shall be signed by a registered civil engineer and approved by
the water company, with the following certification: "I certify that the design
of the water system of Tract No. 17108 is in accordance with the requirements
prescribed by the City Fire Marshal."
12. All private streets shall be inspected by the Engineering Department and a
Standard Inspection Fee shall be paid.
13. All requirements of the Planning Commission action on the Development Plan
07-81 shall be met as a part of the development of this tract.
14. The applicant shall have twelve (12) months from the date of approval or
conditional approval of the tentative map for filing of the final map
unless an extension of time of up to eighteen (18) months is granted by a
Resolution of the City Council.
15. Drainage and Signalization Fund contributions as required by City Ordinance
shall be made prior to recordation of the final map.
16. Drainage facilities shall be provided per Ordinance No. 218 and the Master
Drainage Plan to the specifications of the Public Works Director. The
developer shall construct the Master Plan Storm Drains that traverse the
property in an east -west and north -south direction. No structures shall be
constructed within the storm drain easements.

17. Additional storm drain construction shall be contingent upon a drainage study
by the private engineer.
18. Vehicular access to Highway 111 shall be as approved by Caltrans.
19. The developer shall dedicate sufficient right-of-way as required by Caltrans
and post a bond for five years or until adjacent property develops, whichever
occurs first, for the widening of Highway 111 to three lanes. Improvement
plans shall be submitted to the Public Works Department.
20. Developer shall make a cash payment to the City of Palm Desert for one-half
the cost of the installation of medians on Highway 111.
21. There shall be reciprocal access easements granted between all lots desig-
nated on the tentative map.
22. An easement for cross vehicular access shall be granted to the property to
the west.

Dear Mr. Diaz:
Prior to construction of any of the proposed buildings, the following conditions
must be met:
1. Install a water system capable of delivering 3500 GPM fire flow for a three (3)
hour duration in addition to domestic or other supply. The computation shall
be based upon a minimum of 20 psi residual operating pressure in the supply
main from which the flow is measured at the time of measurement.
2. Install Riverside County super fire hydrants so that no point of any building is
more than 200 feet from a fire hydrant measured along approved vehicular travel ways.
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow,
and the tops and nozzle caps shall be painted green.
C. Curbs (if installed) shall be painted red 15 feet in either direction from
each hydrant.
3. Prior to issuance of a building permit, the developer shall furnish the original
and three (3) copies of the water system plan to the Fire Marshal for review.
Upon approval, one copy will be sent to the Building Department and the original
will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer, and approved
by the water company, with the following certification: "I certify that the
design of the water system in Case Number DP 07-81 is in accordance with the
requirements prescribed by the Fire Marshal."
5. Prior to delivery of combustible materials to the building site, the required
water system shall be installed, operating and delivering the required flow.
