HomeMy WebLinkAboutRes No 717PLANNING COMMISSION RESOLUTION NO. 717 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING A VARIANCE TO ALLOW A 22.5 SQUARE FOOT REGIONAL CENTER MONUMENT SIGN LOCATED AT THE SOUTHWEST CORNER OF HIGHWAY 111 AND HIGHWAY 74. CASE NO. VAR 01-81 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 2nd day of June, 1981, hold a duly noticed Public Hearing to consider a request by COLUMBIA FINANCIAL CORPORATION for approval of a Variance from Section 25.68.390 of the Municipal Code, to allow a 22.5 sq.ft. Regional Center Monument Sign (17.5 sq.ft. permitted) within the PC-3 (Planned Regional Commercial) zone, located at the southwest corner of Highway 111 and Highway 74, more particularly described as: APN 629-720-018 WHEREAS, said applicant has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Serivces has determined that the proposed project is a Class II, Categorical Exemption for the purposes of CEQA. WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts to justify their actions, as described below: a. The strict enforcement of the sign size limit would result in practical difficulty inconsistent with the objectives of the Zoning Ordinance; b. There are exceptional circumstances or conditions applicable to this property that do not apply generally to other properties in the PC (3), S.P. Regional Center, Scenic Preservation Overlay, zone; c. The strict enforcement of the sign size limit would deprive the applicant of privileges enjoyed by the owners of other property in the PC (3), S.P. zone. d. The approval of the variance will not be detrimental to the public health, safety or welfare or materially injurious to property or improvements in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. That the Planning Commission does hereby approve Variance 01-81 subject to the attached conditions. PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 2nd day of June, 1981, by the following vote, to wit: AYES: KRYDER, MCLACHLAN, RICHARDS, MILLER NOES: NONE ABSENT: BERKEY ABSTAIN: NONE CHARLES MILDER, Chairman ATTEST: RA N A. DIAZ, Secrtary PLANNING COMMISSION RESOLUTION NO. 717 Page Two CONDITIONS OF APPROVAL 1. All requirements of any law, ordinance, or regulation of the State, City and and other applicable governmententity shall be complied with as a part of the variance. 2. Specific Sign design, location and color to be approved by Design Review Board. 3. Additional landscaping adjacent to Highway 74 and Highway 111 to be provided as required by Design Review Board.
