HomeMy WebLinkAboutRes No 728PLANNING COMMISSION RESOLUTION NO. 728 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A DEVELOPMENT PLAN TO ALLOW CONSTRUCTION OF A 47 DWELLING UNIT CONDOMINIUM PROJECT ON 9.5 GROSS ACRES ON PROPERTY LOCATED ON THE NORTH SIDE OF HOVLEY LANE, APPROXIMATELY 2600 FEET EAST OF MONTEREY AVE. CASE NO. DP 05-81 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 2nd day of June, 1981, hold a duly noticed Public Hearing, and continued hearings on June 17, and June 30, 1981, to consider the request of T&D CALIFORNIA INVESTMENTS for approval of a residential Development Plan to allow construction of 47 condominium units on 9.5 gross acres within the PR-5 (Planned Residential, maximum 5 d.u./acre) zone, located on the north side of Hovley Lane, approximately 2600 feet east of Monterey Avenue, more particularly described as: APN 621-190-054, 621-190-055 WHEREAS, said application has complied with the Procedure for Implementation of the California Environmental Quality Act, Resolution No.30-89" in that the Director of Environmental Services has determined that the project has been previously assessed in connection with Case No. DP 17-78 and no further documentation is deemed necessary by the Director. WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts to justify their actions, as described below: a. The proposed project generally conforms to the intent and purpose of the PR Zone District. b. The proposed project is adequately suited for the specific site and is compatible with existing and proposed development in the area. c. The proposed project will not be detrimental to the health, safety and general welfare of the community. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. That the Planning Commission does hereby approve DP 05-81 subject to those conditions attached hereto. DIAZ, lcretary /1r PLANNING COMMISSION RESOLUTION NO. 723 Page Two CONDITIONS OF APPROVAL CASE NO. DP 05-81 1. The development of the property shall conform substantially with Exhibit A (Case No. DP 05-81) on file with the Department of Environmental Services, as modified by the following conditions. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval, the applicant shall first complete all the procedural requirements of the City which include, but are not limited to, Design Review, Subdivision process, and building permit procedures. 3. Construction of the total development may be done in phases; however, each individual phase shall meet or exceed all Municipal Code requirements to the degree that the City could consider each phase as a single project. 4. Construction of a portion of said project shall commence within one year from the date of final approval otherwise said approval shall become null, void and of no effect whatsoever, effective date of approval to run from date of approval of TT 14080. 5. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. 6. All existing electrical distribution lines, telephone, cable antenna TV, and similar service wires or cables, which are adjacent to the property being developed shall be installed underground as a part of development from the nearest existing pole not on the property being developed. 7. All requirements of the City Fire Marshal shall be met as part of the development of this project per attached letter dated May 13, 1981. 8. Construction plans shall be submitted for approval to the City Fire Marshal prior to issuance of building permits. All conditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. 9. Traffic control provisions shall be provided as required by the Director of Public Works. 10. Curb, gutter, sidewalk or approved pathways, and tie-in paving shall be provided in conformance with City Standards and/or as required by the Director of Public Works. 11. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Design Review Board Process City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to the Department of Building and Safety at the time of issuance of a building permit for the use contemplated. 12. No development shall occur on the subject property prior to the recordation of a tract map. 13. Applicant shall pay a one hundred dollar per unit fee at the time of issuance of building permits; fee to be used to provide fire suppression facilities. 14. Provide a 20 ft. wide public access easement along Hovley Lane, to be used in conjunction with the parkway for development of an 8 ft. wide meandering pedestrian/bicycle path. PLANNING COMMISSION RESOLUTION NO. 7?8 Page Three 15. Provide ornamental landscaping in the parkway/easement installed and main- tained by the project. 16. Provide a minimum 6 ft. high solid masonry wall around the project with the wall along Hovley Lane to be set back 20 ft. from the property line. 17. Provide wind/blowsand protection planting along the north and west site boundaries. 18. Provide 20 ft. minimum distance between buildings. 19. Provide a minimum of 50% of the net site area in common open space. 20. Provide 20 feet deep driveway apron for all units. 21. Provide security entry with stacking for minimum four vehicles with acceptable turn around for rejected visitors. 22. Recess tennis court if deemed necessary by Design Review Board. 23. Tennis court lighting, if provided, to be down shining black -box with recessed light source. 24. Main vehicular entry to be relocated so that it is across from entry to TT 14997; redesign to be reviewed during Design Review Board process. Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a two hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants located at each street inter- section (a) but not greater than 500 feet apart in any direction. A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. 6. Curbs shall be painted red 15 feet in either direction from each hydrant. 3. Prior to recordation of the final map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: " I certify that the design of the water system in Tract No. 14080 & DP 05-81 is in accordance with the requirements prescribed by the Fire Marshal." Upon approval the original plan will be returned to the developer. 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6.
