HomeMy WebLinkAboutRes No 739PLANNING COMMISSION RESOLUTION NO. 739 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO ALLOW THE CONVERSION OF TWO (2) SINGLE FAMILY DWELLINGS WITHIN THE R-3 ZONE TO PROFESSIONAL OFFICE USE, LOCATED AT 74-058 and 74-070 ALESSANDRO DRIVE. CASE NO. CUP 05-81 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 1st day of September, 1981, hold a duly noticed Public Hearing to consider a request by RONALD GREGORY, ET AL, for approval of a Conditional Use Permit to allow the conversion of two (2) single family dwellings within the R-3 zone to Professional Office Use, located at 74-058 and 74-070 Alessandro Drive, more particularly described as: APN 625-082-011 and 012 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Services has determined that the project is categorically exempted under the guidelines for implementation of the California Environmental Quality Act of 1970 per Section 15101, Class 1. WHEREAS, at said Public Hearing, upon hearing and considering all testi- mony and arguments, if any, of all interested persons desiring to be heard, said Commission did find the following facts and reasons to exist to justify the grant- ing of said Conditional Use Permit: 1. The proposed location of the Conditional Use is in accord with the objectives of the Zoning Ordinance and the purpose of the district in which the site is located. 2. The proposed location of the Conditional Use and the conditions under which it will be operated and maintained will not be detrimental to the public health, safety, or general welfare, or be materially injurious to properties or improvements in the vicinity. 3. The proposed Conditional Use complies with the goals, objectives, and policies of the City's adopted General Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. That approval of Conditional Use Permit 05-81, is hereby granted subject to the attached conditions. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 1st day of September, 1981, by the following vote, to wit: AYES: KRYDER, RICHARDS, WOOD, MILLER NOES: NONE ABSENT: BERKEY ABSTAIN: NONE ATTEST: 7 ,4-34.414 AMON A. That the proposed site plan be revised in accordance with the plan suggested in the staff report dated September 1, 1981. 2. That a 6 foot high masonry wall be constructed along the north, east and west property lines. Said wall in the east and west side, to extend from the rear to the front building setback on each side. 3. That any exterior renovation of the existing structures be subject to the Design Review process. 4. That the conditions of approval of the Director of Public Works as detailed in his memo of August 20, 1981, be implemented. 5. Construction of said project shall commence within one year from the date of final approval; otherwise, said approval shall become null, void and of no effect whatsoever. 6. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and State and Federal Statutes now in force, or which hereafter may be in force. 7. Construction plans shall be submitted for approval to the City Fire Marshal prior to issuance of building permits. All conditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. 8. Curb, gutter, sidewalk, curb cuts, and tie-in paving shall be provided in conformance with City standards to specifications of the Director of Public Works. 9. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Design Review Board Process City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be pre- sented to the Department of Buidling and Safety at the time of issuance of a building permit for the use contemplated herewith. 10. Existing driveways if relocated, shall be removed and replaced with curb and gutter. 11. Prior to final occupancy permit being authorized by the Department of Environ- mental Services, the property owner shall enter into a record agreement acceptable to the City Attorney and running with the land, to voluntarily be a part of any undergrounding district which is subsequently established by the City which includes the subject property within its proposed boundaries. 12. All exterior lighting, including but not limited to parking lot and building lights shall be designed and screened so that there is no light spillover onto adjacent residential properties and public rights -of -way. 13. The applicant will provide a .Mutual Access Agreement. 14. Directional striping to guide traffic in parking lot to be provided.
