HomeMy WebLinkAboutRes No 742PLANNING COMMISSION RESOLUTION NO. 742 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO ALLOW A MAXIMUM OF 24 ADDITIONAL SPACES TO BE ADDED TO AN EXISTING MOBILE HOME PARK IN THE R-1-M ZONE ON PROPERTY LOCATED ON THE WEST SIDE OF PORTOLA AVENUE, SOUTH OF THE WHITEWATER STORM CHANNEL. CASE NO. CUP 09-80 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 16th day of September, 1981, hold a duly noticed Public Hearing to consider a request by PALM DESERT MOBILE ESTATES for approval of a Conditional Use Permit to allow additional spaces to be added to an existing Mobile Home park on 18.8 acres in the R-1-M (Conventional Single Family/Mobile Home Resi- dential District) zone, on property located on the west side of Portola Avenue South of the Whitewater Storm Channel, more particularly described as: APN 621-350-008 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Services has deter- mined that the project will not have a significant impact on the environment and a Negative Declaration of Environmental Impact has been prepared. WHEREAS, at said Public Hearing, upon hearing and considering all testi- mony and arguments, if any, of all interested persons desiring to be heard, said Commission did find the following facts and reasons to exist to justify the granting of said Conditional Use Permit: 1. The proposed location of the Conditional Use is in accord with the objectives of the Zoning Ordinance and the purpose of the district in which the site is located. 2. The proposed location of the Conditional Use and the conditions under which it will be operated and maintained will not be detrimental to the public health, safety, or general welfare, or be materially injurious to properties or improvements in the vicinity. 3. The proposed Conditional Use complies with the goals, objectives, and policies of the City's adopted General Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings to the Commission in this case. 2. That approval of Conditional Use Permit CUP 09-80, is hereby granted for reasons subject to the attached conditions. 3. That a Negative Declaration of Environmental Impact is hereby approved. 4. That said request for a Variance is hereby denied. The development of the property shall conform substantially with Exhibits (Case No. CUP 09-80) on file with the Department of Environmental Services, as modified by the following conditions. 2. Construction of the total development may be done in phases; however, each individual phase shall meet or exceed all Municipal Code requirements to the degree that the City could consider each phase as a single project. 3. Construction of a portion of said project shall commence within one year from the date of final approval otherwise said approval shall become null, void and of no effect whatsoever. 4. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in additions to all municipal ordinances and State and Federal Statutes now in force, or which hereafter may be in force. 5. All requirements of the City Fire Marshal shall be met as part of the develop- ment of this project per attached letter dated July 20, 1981. 6. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Design Review Board Process City Fire Marshal Coachella Valley Wacer District Evidence of said permit or clearance from the above agencies shall be presented to the Department of Building and Safety at the time of issuance of a building permit for the use contemplated herewith. 7. Drainage and signalization fees as required by City ordinance shall be paid prior to Conditional Use Permit issuance. 8. Improvement plans for water and sewer systems shall be approved by the respective service districts. 9. All private streets shall be inspected by the engineering department and a standard inspection fee shall be paid. 10. Complete improvement plans and specifications shall be submitted as required by ordinance to the City Engineer for checking and approval before construc- tion of any improvement is commenced. The subdivider shall submit reproducible as -built plans of the subdivision improvements to the City. 11. Drainage facilities shall be provided per Ordinance No. 218 and the Master Drainage Plan to the specifications of the Director of Public Works. 12. Full public improvements, including traffic safety lighting as required by ordinance and the Director of Public Works, shall be installed in accordance with City standards. 13. Full public half street improvements and dedication, including traffic safety lighting shall be provided on Magnesia Falls Drive, as required by Ordinance and the Director of Public Works. Prior to any work authorized by this approval beginning, clearance from AO-1 designation on Federal Flood Insurance Rate Maps shall be obtained from the Director of Public Works. 15. Normal 24 foot wide entrance/exit shall be provided to Magnesia Falls Drive in place of emergency access proposed. 16. If acceptable emergency access to Portola Avenue cannot be provided, Northern cul-de-sac bulb to be provided with 40 foot radius; if revision is necessary, spaces to be revised as approved by Department of Environ- mental Services. 17. 6 foot high wall or fence design and landscaping adjacent to Magnesia Falls Drive to be approved by Design Review Board. . 18. Three new guest parking bays shall be provided. 19. Plans for protective measures along Whitewater Storm Channel shall be submitted to the Coachella Valley Water District for review. Install a water system capable of delivering 2500 GPM fire flow for a two (2) hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. A. Hydrants shall not be located closer than 25 feet to any buildings. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. C. Curbs (if installed), shall be painted red 15 feet in either direction from each hydrant. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal fro review. Upon approval, one copy will be sent to the Building Department, and the original will be returned to the developer. PLANNING COMMISSION RESOLUTION NO. 742 Page SIX Mr. Ramon A. The water system plan shall be signed by a registered civil engineer, and approved by the water company, with the following certification: r'I certify that the design of the water system in Case Number Cup 09-80 is in accordance with the requirements prescribed by the Fire Marshal." 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Provide emergency access from end of cul de sac at north end of park. 7. Cul de sac radius minimum is 40 feet. u2 zs 8. Emergency access road minimum width is 20 feet. 9.
