A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF PALM DESERT APPROVING
A CONDITIONAL USE PERMIT TO ALLOW CON-
VERSION OF 848 SQUARE FEET OF FLOOR AREA
WITHIN AN EXISTING DELICATESSEN TO
RESTAURANT USE IN THE C-1 ZONE LOCATED
AT THE NORTHWEST CORNER OF SAN PABLO
AVENUE AND HIGHWAY 111.
CASE NO. CUP 06-81
WHEREAS, the Planning Commission of the City of Palm Desert, California
did on the 29th day of September, 1981, hold a duly noticed Public Hearing to
consider a request by RICHARD NICHOLS, for approval of a Conditional Use Permit
to allow the conversion of 848 square feet of floor area within an existing
delicatessen for sit-down restaurant and kitchen use in the C-1 S.P. (General
Commercial, Scenic Preservation) zone, located at the northwest corner of San
Pablo Avenue and Highway 111, more particularly described as:
Lots 4, 5, 6, 7 Palm Village Plaza Tract
WHEREAS, said application has complied with the requirements of the
"City of Palm Desert Procedures to Implement the California Environmental Quality
Act, Resolution No. 80-89", in that the Director of Environmental Services has
determined that the project is categorically exempted under the guidelines for
implementation of the California Environmental Quality Act of 1970 per Section
15101, Class 3.
WHEREAS, at said Public Hearing, upon hearing and considering all testi-
mony and arguments, if any, of all interested persons desiring to be heard, said
Commission did find the following facts and reasons to exist to justify the grant-
ing of said Conditional Use Permit:
1. The proposed location of the Conditional Use is in
accord with the objectives of the Zoning Ordinance
and the purpose of the district in which the site
is located.
2. The proposed location of the Conditional Use and the
conditions under which it will be operated and
maintained will not be detrimental to the public
health, safety, or general welfare, or be materially
injurious to properties or improvements in the vici-
nity.
3. The proposed Conditional Use complies with the goals,
objectives, and policies of the City's adopted General
Plan.
4. The nature and peak hours of the proposed use and
surrounding uses are such that existing parking faci-
lities are sufficient to meet expected demands.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of Palm Desert, California, as follows:
1. That the above recitations are true and correct and
constitute the findings of the Commission in this case.
2. That approval of Conditional Use Permit 06-81, is
hereby granted subject to the attached conditions.

CONDITIONS OF APPROVAL
CASE NO. CUP 06-81
1. The applicant must comply with all City of Palm Desert Department of
Building and Safety and Riverside County Health Department requirements
for restaurant use.
2. The areas of restaurant use shall conform with those areas designated
on the approved plot plan exhibit "A" on file in the Department of Environ-
mental Services.
3. Applicant agrees to participate in any future parking assessment district
designed to improve parking availability in the north Highway 111/San
Pablo area.
4. The applicant shall remove the existing temporary paper sign and in the future
shall comply with all laws and ordinances of the City of Palm Desert, County
of Riverside and State of California.
5. If the applicant requests additional permanent signage to identify the res-
taurant a sign program covering the entire Hwy 111 frontage must be submitted
to the Department of Environmental Services for review.
