A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF PALM DESERT APPROVING
FINDINGS AND AMENDMENT TO A CONDITIONAL
USE PERMIT TO ALLOW CONVERSION OF 480
SQUARE FEET OF A DELICATESSEN, TO
RESTAURANT USE IN THE PINARD CENTER,
SUITE #2, LOCATED AT 74-063 HIGHWAY 111.
CASE NO. CUP 01-78 (AMENDMENT)
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 29th of September, 1981, hold a duly noticed Public Hearing to consider
a request by CARLO S. VETRANO for an Amendment to an existing Conditional Use
Permit to allow the conversion of 480 square feet within an existing delicatessen
to sit-down restaurant use within the C-1 S.P. (General Commercial, Scenic Preser-
vation Overlay) zone, located at 74-063 Highway 111, more particularly described
as:
APN 625-111-026
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the Director of Environmental Services has determined
that the project is categorically exempted under the guidelines for implementation
of the California Environmental Quality Act of 1970 per Section 15101, Class 3.
WHEREAS, at said Public Hearing, upon hearing and considering all testi-
mony and arguments, if any, of all interested persons desiring to be heard, said
Commission did find the following facts and reasons to exist to justify the grant-
ing of said Conditional Use Permit:
1. The proposed location of the Conditional Use is in
accord with the objectives of the Zoning Ordinance
and the purpose of the district in which the site
is located.
2. The proposed location of the Conditional Use and the
conditions under which it will be operated and
maintained will not be detrimental to the public
health, safety, or general welfare, or be materially
injurious to properties or improvements in the vici-
nity.
3. The proposed Conditional Use complies with the goals
objectives, and policies of the City's adopted General
Plan.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of Palm Desert, California, as follows:
1. That the above recitations are true and correct and
constitute the findings of the Commission in this
case.
2. That approval of an amendment to Conditional Use
Permit 01-78, is hereby granted subject to the
attached conditions.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
PLANNING COMMISSION RESOLUTION NO. 747 PAGE TWO
Planning Commission, held on this 29th day of September, 1981, by the following
vote, to wit:

CONDITIONS OF APPROVAL
CASE NO. CUP 01 -78
1. The applicant must comply with all City of Palm Desert Department of Building
and Safety and Riverside County Health Department requirements for restaurant
use.
2. The areas of restaurant use shall conform with those areas designated on the
approved plot plan exhibit "C" on file in the Department of Environmental
Services.
