HomeMy WebLinkAboutRes No 755PLANNING COMMISSION RESOLUTION NO. 755 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO ALLOW CONSTRUCTION AND OPERATION OF A RADIO STATION AND OFFICE ON A 16,000 SQUARE FEET LOT IN THE R-1, 12,000 ZONE AT THE SOUTHEAST CORNER OF ACACIA DRIVE AND PARK VIEW DRIVE. CASE NO. CUP 09-81 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 3rd day of November, 1981, hold a duly noticed public hearing to consider a request by RENAISSANCE LAND COMPANY (A PARTNERSHIP OF PAUL F. POSEN) for approval of a Conditional Use Permit to allow the construction and operation of a radio station and office on a 16,000 sq.ft. lot in the R-1 12,000 (Single Family Residential District, 12,000 sq.ft. minimum lot size) zone at the southeast corner of Acacia Drive and Park View Drive, more particularly described as: APN 621-334-001 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Services has determined that the project is categorically exempted per the Guidelines for Implementation of the California of the California Environmental Quality Act, Section 15103. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Commission did find the following facts and reasons to exist to justify the granting of said Conditional Use Permit: 1. The proposed location of the Conditional Use is in accord with the objectives of the Zoning Ordinance and the purpose of the district in which the site is located. 2. The proposed location of the Conditional Use and the conditions under which it will be operated and maintained will not be detri- mental to the public health, safety, or general welfare, or be materially injurious to properties or improvements in the vicinity. 3. The proposed Conditional Use complies with the goals, objectives, and policies of the City's adopted General Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Paml Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. That approval of Conditional Use Permit 09-81 is hereby granted for reasons subject to the attached conditions. The development of the property shall conform substantially with Exhibits on file with the Department of Environmental Services, as modified by the following conditions. 2. Construction of a portion of said project shall commence within one year from the date of final approval otherwise said approval shall become null, void and of no effect, whatsoever, unless an extension of time is granted. 3. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and State and Federal Statutes now in force, or which hereafter may be in force. 4. All requirements of the City Fire Marshal shall be met as a part of the development of this project per attached letter dated October 13, 1981. 5. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Design Review Board Process City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to the Department of Building and Safety at the time of issuance of a building permit for the use contemplated herewith. 6. Drainage and Signalization fees as required by City ordinance shall be paid prior to Conditional Use Permit issuance. 7. Improvement plans for water and sewer systems shall be approved by the respective service districts. 8. An agreement shall be recorded guaranteeing that the property will voluntarily be a part of any undergrounding district which is subsequently established by the City including the property in question. 9. Curb, gutter, or approved pathways, and tie-in paving shall be provided in conformance with City Standards and/or as required by the Director of Public Works. 10. A total of 10 off-street parking spaces shall be provided including one handicap space (12' x 20'). 11. Masonry walls to be decorative, with landscaping designed to be attractive buffer. 12. Applicant to employ an Architect to design building at Design Review Board level. 13. Trash enclosure with doors shall be provided within parking lot area. 14. Dedication of right-of-way to 44 feet from centerline on Park View Drive. 15. Installation of curb and gutter at 32 feet from centerline and matching paving on Acacia Drive. 16. Installation of curb and gutter at 20 feet from centerline and matching paving on Acacia Drive. -2- PLANNING COMMISSION RESOLUTION NO. 755 17. Full public improvements, including traffic safety lighting as required by ordinance and the Director of Public Works, shall be installed in accordance with City standards. 18. Complete improvement plans and specifications shall be submitted as required by ordinance to the Director of Public Works for checking and approval before construction of any improvements is commenced. Install a water system capable of delivering 2500 GPM fire flow for a two (2) hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant along approved vehicular travel ways. A. Hydrants shall not be located closer than 25 feet to any building. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. C. Curbs (if installed), shall be painted red 15 feet in either direction from each hydrant. 3. Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. Upon approval, one copy will be sent to the Building Department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer, and approved by the water company, with the following certification: "I certify that the design of the water system in Case Number CUP 09-81 is in accordance with the requirements prescribed by the Fire Marshal."
