HomeMy WebLinkAboutRes No 764PLANNING COMMISSION RESOLUTION NO. 764 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 10-81 AND CERTIFICATION OF NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT THEREFORE. CASE NO. CUP 10-81 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 3rd day of December, 1981, hold a duly noticed Public Hearing to consider a request by the City of Palm Desert to approve a Conditional Use Permit to allow the development of a Civic Center located at the northeast corner of Fred Waring and San Pablo; and, Certification of a Negtive Declaration of Environmental Impact therefore; WHEREAS, said application has complied with the requirements of the "City of Palm Deert Procedures to Implement the California Environmental Quality Act, Resolution 80-89"; WHEREAS, Environmental Impact Report 81-1 entitled "Environmental Impact Report Proposed Development of Civic Center complex for the City of Palm Desert" was certified by the City Council on October 22, 1981; WHEREAS, there have not been any changes in the environment since the certification of said EIR warranting the certification of a Negative Declaration of Environmental Impact, which adopts said EIR 81-1 by reference; and, WHEREAS, at said Public Hearing, upon hearing and considering staff report dated December 1, 1981, as well as, all testimony and arguments of all interested persons desiring to be heard, said Commission did find the following facts and reasons to exist to justify the granting of said Conditional Use Permit: 1. The proposed location of the Conditional Use is in accord with the objectives of the Zoning Ordinance and the purpose of the district in which the site is located. 2. The proposed location of the Conditional Use and the conditions under which it will be operated and maintained will not be detrimental to the public health, safety, or general welfare, or be materially injurious to the properties or improvements in the vicinity. 3. The proposed Conditional Use will comply with each of the applicable provisions of the Zoning Ordinance. 4. The proposed Conditional Use complies with the goals, objectives and policies of the City's adopted General Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That approval of Conditional Use Permit 10-81 is hereby granted subject to the following condition: "The City shall assure that all mitigation measures set forth in Environmental Impact Report 81-1, are implemented." PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 1st day of December, 1981, by the following vote, to wit: AYES: NOES: ABSENT: ABSTAIN: ATTEST: /lr A.
