HomeMy WebLinkAboutRes No 766PLANNING COMMISSION RESOLUTION NO 766 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND APPROVING A TENTATIVE PARCEL MAP FOR FINANCING PURPOSES IN THE PR-3, S.P. ZONE LOCATED ON THE EAST SIDE OF COOK STREET, BETWEEN FRANK SINATRA DRIVE AND COUNTRY CLUB DRIVE. CASE NO. PM 18401 WHEREAS, the Planning Commission of the City of Palm Desert, California, did hold a duly noticed Public Hearing on the 16th day of December, 1981, to consider the request of DESERT FALLS DEVELOPMENT COMPANY for approval of a Parcel Map to divide 389 net (404 gross) acres into 10 parcels of minimum 20 acres size for financing purposes in the PR-3, S.P. zone, located on the east side of Cook Street, between Frank Sinatra Drive and Country Club Drive, more particularly described as: APN's 619-021-001, 002, 003 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Services has determined that the project has previously been assessed in connection with Case Nos. DP 09-79 and TT 15000 and no further documentation is deemed necessary. WHEREAS, at said Public Hearing, upon hearing and considering the testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts and reasons to exist to justify approval of the Parcel Map: 1. That the proposed map is consistent with applicable general and specific plans. 2. That the design or improvement of the proposed subdivision is consistent with applicable general and specific plans. 3. That the site is physically suitable for the type of development. 4. That the site is physically suitable for the proposed density of development. 5. That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. 6. That the design of the subdivision or the type of improvements is not likely to cause serious public health problems. 7. That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That it does hereby approve the above described Tentative Parcel Map No. 18401 subject to fulfillment of the attached conditions. PASSED, APPROVED, and ADOPTED at a regular meeting of the Palm Desert -1- PLANNING COMMISSION RESOLUTION NO. 766 Planning Commission, held on this 16th day of December, 1981, by the following vote, to wit: AYES: CRITES, KRYDER, RICHARDS, MILLER, WOOD NOES: NONE ABSENT: NONE ABSTAIN: NONE GEOR . The Tentative Parcel Map is granted for the land as described in the attachments, hereto, and as shown on the map labeled, Exhibit A, and the requirements herein. 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity, shall be complied with as a part of this map. 3. All parcels shown on TT 15000, created by PM 18401, shall be developed as per DP 09-79, and as approved by the City of Palm Desert.
