HomeMy WebLinkAboutRes No 789PLANNING COMMISSION RESOLUTION NO. 789 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A RESTAURANT IN AN EXISTNG BUILDING AT THE SOUTHEAST CORNER OF SAN LUIS REY AVENUE AND PALM DESERT DRIVE. CASE NO. CUP 03-82 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 6th day of April, 1982, hold a duly noticed public hearing to consider a request by MARIO LALLI for approval of a conditional use permit to allow a restaurant in an existing building in a C-1, S.P. zone (General Commercial, Scenic Preservation Overlay) at the southeast corner of San Luis Rey and Palm Desert Drive, more particularly described as: APN 627-222-053 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Services has determined that the project is a Class 3 Categorical Exemption. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, of all interested persons desiring to be heard, said Commission did find the following facts and reasons to exist to justify the granting of said Conditional Use Permit: 1. The proposed location of the Conditional Use is in accord with the objectives of the Zoning Ordinance and the purpose of the district in which the site is located. 2. The proposed location of the Conditional Use and the conditions under which it will be operated and maintained will not be detrimental to the public health, safety or general welfare, or be materially injurious to properties or improvements in the vicinity. 3. The proposed Conditional Use will comply with each of the applicable provisions of this title, except for approved variances or adjustments. 4. The proposed Conditional Use complies with the goals, objectives, and policies of the City's adopted General Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case. 2. That approval of Conditional Use Permit 03-82 is hereby granted for reasons subject to the attached conditions. The development of the property shall conform substantially with exhibits on file with the Department of Environmental Services, as modified by the following conditions. 2. Prior to the issuance of a building permit for remodeling of any uses contemplated by this approval, the applicant shall first complete all the procedural requirements of the City which include, but are not limited to, Design Review and building permit procedures. 3. Use of the permit shall commence within one year from the date of final approval otherwise said approval shall become null, void and of no effect whatsoever, unless a time extension is granted. 4. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 5. Construction plans shall be submitted for approval to the City Fire Marshal and Building and Safety Department prior to issuance of building permits. All conditions shall be made a part of construction and no certificate of occupancy shall be issued until completed. 6. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Design Review Board Process City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to the Department of Building and Safety at the time of issuance of a building permit for the use contemplated herewith. 7. Restaurant not to open for business before 5:00 p.m. weekdays. 8. No valet parking shall be allowed at any time. 9. Landscaping and permanent irrigation system shall be provided at the height of 3 feet in the unusable portion of the parking areas adjacent to Palm Desert Drive.
