HomeMy WebLinkAboutRes No 808PLANNING COMMISSION RESOLUTION NO. 808 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A DEVELOPMENT PLAN AND NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT TO ALLOW CONSTRUCTION OF A CHURCH WITH RELATED FACILITIES IN THE PR-5 ZONE, LOCATED ON THE SOUTH SIDE OF HOVLEY LANE, APPROXIMATELY 1325 FEET EAST OF MONTEREY AVENUE. CASE NO. DP 02-82 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 6th day of July, 1982, hold a duly noticed public hearing to consider a request by DESERT EVANGELICAL FREE CHURCH for approval of a development plan and negative declaration of environmental impact to allow construction of a church with related facilities on 4.77 acres in the PR-5 zone, located on the south side of Hovley Lane approximately 1325 feet east of Monterey Avenue, more particularly described as: APN 622-020-022 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project will not have any significant adverse impact on the environment and a negative declaration has been prepared. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find the following facts to justify their actions, as described below: 1. The proposed project generally conforms to the intent and purpose of the PR zone district. 2. The proposed location of the use is in accord with the objectives of the zoning ordinance and the purpose of the district in which the site is located. 3. The proposed location of the use and the conditions under which it will be operated and maintained will not be detrimental to the public health, safety, or general welfare, or be materially injurious to properties or improvements in the vicinity. 4. The proposed use will comply with each of the applicable provisions of this title, except for approved variances or adjustments. 5. The proposed use complies with the goals, objectives, and policies of the city's adopted General Plan. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That the Planning Commission does hereby approve Conceptual Development Plan No. 02-82 subject to those conditions attached hereto. 3. That a negative declaration of environmental impact is hereby approved. DIAZ, Secreta /pa -2 eGEOR �� D. KRYhairman PLANNING COMMISSION RESOLUTION NO. 808 CONDITIONS OF APPROVAL CASE NO. DP 02-82 Department of Environmental Services: 1. The development of the property shall conform substantially with exhibits on file with the department of environmental services, as modified by the following conditions. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval, the applicant shall first complete all the procedural requirements of the city which inlcude, but are not limited to design review and building permit procedures. 3. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to allow municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 4. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. 5. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Design Review Board Process City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 6. Detailed exterior lighting plan in compliance with applicable standards to be submitted to the city for approval; lights to be down shining box type to minimize glare with 20 foot high light standards. 7. Six (6) foot high (on both sides) decorative block wall shall be provided as a part of Phase I along west and south (if deemed necessary by the city) property lines, to satisfaction of city; said wall on easterly property line may be constructed with the beginning of Phase II or when development occurs to the east, whichever occurs first. Q 8. Construction of the total development may be done in phases; however, each individual phase shall meet or exceed all municipal code requirements to the degree that the city could consider each phase a single project. 9. No existing trees shall be removed from the site without approval of the department of environmental services. 10. 24 foot wide driveway to Phase I parking area to be provided along east and west side so that complete circulation from the street is provided. 11. Parking area to be screened from the street through the use of berming and/or walls and landscaping. 3 PLANNING COMMISSION RESOLUTION NO. 808 Department of Environmental Services (Continued) 12. Signs not approved as a part of application; signs to be reviewed and approved by Design Review Board. 13. Blowsand protection to be provided for large outdoor areas as developed. 14. All existing electrical distribution lines, telephone, cable antenna television and similar service wires or cables, which are adjacent to and provide service to the property being developed shall be installed underground as a part of development from the nearest existing pole not on the property being developed pursuant to municipal code requirements, unless determined to be unfeasible by the city. Department of Public Works: 1. Dedication of right of way to 44 feet from centerline on Hovley Lane shall be given. 2. Installation of curb and gutter at 32 feet from centerline, matching paving and sidewalk. 3. Complete improvement plans and specifications shall be submitted as required by ordinance to the city engineer for checking and approval before construction of any street improvements is commenced. 4. The applicant shall submit as -built plans prior to acceptance of the improvements by the city. 5. All public improvements shall be installed in accordance with city standards. All street improvements are required in conjunction with Phase I of the project. City Fire Marshal: 1. Install a water system capable of delivering 3000 GPM fire flow for a two (2) hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the following is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. A. Hydrants shall not be located closer than 25 feet to any building. B. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. C. Curbs (if installed) shall be painted red 15 feet in either direction from each hydrant. 3. Prior to issuance of a building permit, the developer shall furnish the original and three (3) copies of the water system plan to the fire marshal for review. Upon approval, one copy will be sent to the building department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Case Number DP 02-82 is in accordance with the requirements prescribed by the fire marshal." 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. /pa 4
