A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM DESERT, CALIFORNIA, APPROVING
A COMMERCIAL DEVELOPMENT PLAN TO ALLOW
COSNTRUCTION OF A 204 UNIT HOTEL AND
RESTAURANT WITH CONFERENCE ROOMS ON 9.32
ACRES LOCATED ON THE NORTH SIDE OF HIGHWAY
111, 650 FEET EAST OF DEEP CANYON ROAD AND
CERTIFYING A NEGATIVE DECLARATION OF
ENVIRONMENTAL IMPACT AS IT PERTAINS THERETO.
CASE NO. DP 07-81 (AMENDMENT NO. 1)
WHEREAS, the planning commission of the City of Palm Desert, California, did on
the 7th day of September, 1982, hold a duly noticed public hearing to consider a request
by BERNARD SOLOMON for approval of a commercial development plan to allow
construction of a 204 unit hotel and restaurant (planned resort commercial, natural
factors, scenic preservation overlay zone), and PR-5, N (planned residential, maximum 5
d.u./acre, natural factors) zone, located on the north side of Highway 111, 650 feet east
of Deep Canyon, more particularly described as:
APN 625-100-008, 009, 011, 017 thru 020
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the director of environmental services has determined that
the project will not have a significant adverse impact on the environment and a negative
declaration has been prepared.
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said planning commission
did find the following facts to justify their actions, as described below:
a. The proposed project generally conforms to the intent and purpose of the PR
zone district, and PC-4 zone district.
b. The proposed project is adequately suited for the specific site and is
compatible with existing and proposed development in the area.
c. The proposed project will not be detrimental to the health, safety and
general welfare of the community.
NOW, THEREFORE, BE IT RESOLVED by the planning commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the findings
of the commission in this case.
2. That the planning commission does hereby approve Conceptual Development
Plan No. 07-81 Amendment No.1 subject to those conditions attached
hereto.
3. That a negative declaration of environmental impact is hereby certified.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 7th day of September, 1982, by the following vote, to
wit:

CONDITIONS OF APPROVAL
CASE NO. DP 07-81 AMENDMENT NO. 1
1. The development of the property shall conform substantially with Exhibits (Case
No. DP 07-81 Amendment No. 1) on file with the department of environmental
services, as modified by the following conditions.
2. Prior to the issuance of a building permit for construction of any uses
contemplated by this approval, the applicant shall first complete all the procedural
requirments of the city which include, but are not limited to, design review,
subdivision process and building permit procedures.
3. Construction of the total development may be done in phases; however, each
individual phase shall meet or exceed all municipal code requirements to the
degree that the city could consider each phase as a single project.
4. Construction of a portion of said project shall commence within one year from the
date of final approval otherwise said approval shall become null, void and of no
effect whatsoever.
5. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all municipal
ordinances and state and federal statutes now in force, or which hereafter may be
in force.
6. All existing electrical distribution lines, telephones, cable antenna television and
similar service wires or cables, which are adjacent to the property being developed
shall be installed underground as a part of development from the nearest existing
pole not on the property being developed.
7. All requirements of the city fire marshal shall be met as part of the development
of this project per attached letter dated May 13, 1981.
8. Construction plans shall be submitted for approval to the city fire marshal prior to
issuance of building permits. All conditions shall be made a part of construction
and no certificate of occupancy shall be issued until completed.
9. Traffic control provisions shall be provided as required by the director of public
works.
10. Curb, gutter, sidewalk or approved pathways and tie-in paving shall be provided in
conformance with city standards and/or as required by the director of public works.
11. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:
Riverside County Department of Health
Palm Desert Design Review Board Process
City Fire Marshal
Coachella Valley Water District
Evidence of said permit or clearance from the above agencies shall be presented to
the department of building and safety at the time of issuance of a building permit
for the use contemplated herewith.
12. Drainage and signalization fund fees as required by city ordinance shall be paid
prior to recordation of the final map.

13. Full public improvements, including traffic safety lighting as required by ordinance
and the public works director, shall be installed in accordance with city standards.
14. Improvement plans for water and sewer systems shall be approved by the
respective service districts.
15. Complete improvement plans and specifications shall be submitted as required by
ordinance to the city engineer for checking and approval before construction of any
improvements is commenced. The subdivider shall submit "as -built" plans prior to
acceptance of the subdivision improvements by the city.
16. All private streets shall be inspected by the engineering department and a standard
inspection fee shall be paid.
17. Additional storm drain construction shall be contingent upon a drainage study by
the private engineer.
18. Vehicular access to Highway 111 shall be as approved by Caltrans.
19. The developer shall dedicate sufficient right-of-way as required by Caltrans and
post a bond for five years or until adjacent property develops, whichever occurs
first, for the widening of Highway 111 to three lanes. Improvement plans shall be
submitted to the public works department.
20. Developer shall make a cash payment to the City of Palm Desert for one-half the
cost of the installation of medians in Highway 111.
21. Parking area to be screened from Highway 111 by use of berming and landscaping.
22. Along the boundary with the condominium development to the north and west,
install and maintain a minimum 7 foot solid hedge and or increase the height of the
existing wall to seven feet.
23. Tennis courts shall be sunk 4 feet below the grade of adjacent land. Tennis court
lighting shall not spill over to adjacent property.
24. Street lighting of perimeter drive shall be directed away from residential uses on
the north and west.
25. Final landscaping plans to be submitted and approved prior to issuance of
foundation permits.
26. The applicant shall pay a fee to be determined by the City Engineer toward the
installation of a traffic signal.
27. All mechanical equipment associated with the development shall be equipped with
manufacturer -supplied noise control devices and screened from Hidden Palms both
so that the equipment is neither seen nor heard from the adjacent property and
subject to satisfaction of design review board.
28. The applicant shall be required to grant a reciprocal mutual access agreement to
the adjacent property owners to the east and west.
29. Applicant shall contribute his fair share for the construction of signalization at
Highway 111 and the project entrance.
