HomeMy WebLinkAboutRes No 826PLANNING COMMISSION RESOLUTION NO. 826 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, SETTING FORTH ITS FINDINGS AND APPROVING A TENTATIVE PARCEL MAP CREATING TWO AIR SPACE CONDOMINIUM UNITS AT 43-343 CALLAWAY COURT. CASE NO. PM 18916 WHEREAS, the Planning Commission of the City of Palm Desert, California, did hold a duly noticed public hearing on the 19th day of October, 1982, to consider the request of LEWIS HOMES for approval of a tentative parcel map to create two air space condominium units on one parcel in the R-2 (5) S.P. (Single Family Residential, 8.7 d.u./ac., scenic preservation overlay) zone located at the north end of Callaway Court, north of Rutledge Way, more particularly described as: Lot 10, TT 12181-1 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project has been previously assessed in connection with TT 12181-1 and therefore, no further documentation is deemed necessary. WHEREAS, at said public hearing, upon hearing and considering the testimony and arguments if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify approval of the parcel map: 1. That the proposed map is consistent with applicable general and specific plans. 2. That the design or improvement of the proposed subdivision is consistent with applicable general and specific plans. 3. That the site is physically suitable for the type of development. 4. That the site is physically suitable for the proposed density of development. 5. That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. 6. That the design of the subdivision or the type of improvements are not likely to cause serious public health problems. 7. That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision. NOW, THEREFORE, BE IT RESOLVED by the planning commission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case; 2. That it does hereby approve the above described Tentative Parcel Map No. 18916. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert Planning Commission, held on this 19th day of October, 1982, by the following vote, to wit: AYES: NOES: ABSENT: ABSTAIN: CRITES, DOWNS, KRYDER, RICHARDS, WOOD NONE NONE NONE RALPH WOOD, Chairman RAMON A.
