A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF PALM DESERT, CALIFORNIA
RECOMMENDING TO THE CITY COUNCIL THAT THE
PALM VALLEY AREA SPECIFIC PLAN BE RESCINDED,
THAT THE WEST HILLS SPECIFIC PLAN BE ADOPTED
AND THAT A NEGATIVE DECLARATION OF
ENVIRONMENTAL IMPACT AS IT PERTAINS THERETO
BE APPROVED.
CASE NO. GPA 03-82
WHEREAS, the planning commission did on the 5th day of October, 1982, hold
a duly noticed public hearing and a continued public hearing on November 8, 1982 and
December 7, 1982, to consider the rescinding of the Palm Valley Area Specific Plan and
the adoption of the West Hills Specific Plan relating to hillside development policies for
the area generally bound by the Palm Valley Channel and the western city limits; and,
WHEREAS, the director of environmental services has determined that the
amendment will not have a significant adverse impact on this environment and a Negative
Declaration of Environmental Impact has been prepared; and,
WHEREAS, at said public hearing, upon hearing and considering the testimony
and arguments of all persons desiring to be heard, said planning commission did find the
following facts and reasons to exist to recommend the rescinding of the Palm Valley Area
Specific Plan and the adoption of the West Hills Specific Plan:
1. The policies contained within the Palm Valley Area Specific Plan were
based upon a faulty topographic analysis and contradict long standing city
goals concerning development of steep hillside areas.
2. The implementation of the policies contained within the Palm Valley Area
Specific Plan would result in a threat to the public health, safety and
general welfare of the entire community.
3. The proposed West Hills Specific Plan provides policies which will both
fulfill the city's desire to preserve the environment and allow property
owners a reasonable use of their land.
4. The West Hills Specific Plan will ensure the preservation of the public
health, safety and general welfare of the entire community.
NOW, THEREFORE, BE IT RESOLVED by the planning commission of the City
of Palm Desert, as follows:
1. That the above recitations are true and correct and constitute the
findings of the commission in this case.
2. That it does hereby recommend approval to the City Council that the
Palm Valley Area Specific Plan be rescinded and that the West Hills
Specific Plan be adopted for reasons set out in this resolution.
3. That a Negative Declaration of Environmental Impact is hereby
recommended for approval.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
Planning Commission, held on this 7th day of December, 1982, by the following vote to
wit:

ABSENT: NONE
ABSTAIN: CRITES, RICHARDS
